Commissioners:   Lloyd Allen, Brad Sweet, John Rogers and Steve Cook

Staff Present:  Drew McManus (Conservation Agent) and Kris Carpenter (Administrative Secretary)

Call Meeting To Order:  6:55 pm


The meeting was called to order with a quorum by Commissioner Allen at 6:55 pm.

There was no public comment.


Pre/Post Hearing Agenda:  

  • Minutes:   Approval of the following minutes:  N/A
  • Town Solarbee Project for Santuit Pond:  Recommended RDA filing – Agent McManus explains that this project was briefly discussed at the last meeting to get a filing determination recommendation and there was not a consensus reached at that time.  When an agent is unsure of the determination, it is recommended to the applicant that an RDA be filed so that the Commissioners can make a formal decision on the type of permitting that will be required.
  • Mass Fish & Wildlife NEC Project:  Filing update and review of conditions; The New England Cottontail project – The Agent is waiting for a more detailed narrative from Mr. Scarpitti that will include a clearing methodology for work within the 100 ft buffer to any wetland areas. The Agent will send the conditions to all the Commissioners for review.  Mr. Sweet suggests using opportunities to educate the community by publishing; possibly with the Enterprise and some other places.
  • Americorps Update:   Herring run walks - February 27th at 8:30-9:00am - The Agent will be meeting with volunteers from Americorp to walk the upper reaches of the Mashpee and Quashnet Rivers.  They will be performing some vegetation clearings along the Mashpee herring run and it was also suggested to scatter brush piles over ATV trails.

7:00    Karen Scott (750 Cotuit Road) Permit/renew existing Chapter 91 licensed dock – RDA

        [9:54] Ms. Scott explains that she is looking to renew her Chapter 91 license for an existing dock.  Agent McManus states that Chapter 91 has requested permitting from the local Conservation dept for license renewals.  The Agent explains that the Harbormaster is now requiring address identification displayed on each section of the dock.  Mr. Cook asks about the location of storage during off season and the Agent responds that it is placed on the beach in a sandy area.

7:03    Kevin Mulgrew  **43-2687**  (33 Sunset Circle) Construct wood retaining wall, fieldstone retaining wall and replace turf & patio area with sand and compensatory plantings -  NOI  **Continued to March 8, 2012 @ 7:03pm**

7:06    Brian Casey (20 Mutiny Way) Upgrade septic to Title V.  Existing system shall be pumped, filled with clean material and abandoned or removed and disposed of at a suitable landfill -  RDA

        [14:10] Barbara Frappier from Warwick & Associates is standing in for Jack Landers-Cauley and explains that they are proposing a septic system upgrade to a new Title V system.  It will consist of a denitrification system because of the proximity to the wetland resource area.  Agent McManus asks if the retaining wall will be rebuilt in the same footprint and same material.  Ms Frappier responds that it will be rebuilt in kind.  The Agent states that when the wall is being reconstructed, the permit will be conditioned to require siltation for erosion control.   Agent McManus reads the Board of Health comments for the record.

7:09    Brian Casey (12 Sagamore Road) Upgrade septic to Title V.  Existing system shall be pumped, filled with clean material and abandoned or removed and disposed of at a suitable landfill - RDA

[19:19] Barbara Frappier is also representing this project which is also a proposal for a septic system upgrade to a new Title V.  This system will be installed with a denitrification system as it is within 100 ft to a certified vernal pool.  Ms. Frappier explains that there is an existing stone wall that will not be replaced.  Agent McManus will condition this permit requesting a methodology for access and siltation control.  The Agent reads the Board of Health comments for the record.  Mr. Cook asks where the existing tank is currently and Ms. Frappier explains that she is unsure because she did not do the drawing.  Agent McManus explains that standard procedure is to pump and fill but if there is any equipment that needs to access the back then he will need to know the details.

7:12    Susan Sieloff (121 Ninigret Avenue) Install three helical piles on the east corner of the home - RDA

[24:04] Ms. Sieloff explains that the house is situated on a steep slope that will require foundation stabilization due to a discovered crack in the foundation.  They are proposing helical piles that will be installed by hand and should be complete within three days.  Agent McManus asks approximately how long these piles will last and Ms. Sieloff guesses that they could last possibly 50 years.  Mr. Cook asks how big the holes are and Mr. Sieloff (Ms. Sieloff’s husband) states approximately 8-10” wide in diameter.  Agent McManus does not think siltation will be effective because of the steep slope but he can condition the permit for the applicant to take all reasonable measures to protect the resource area.

7:15    Lemonia Macropoulos (88 Cayuga Avenue) Remove five trees that are close to home that is damaging the deck and roof and are also potentially hazardous to the dwelling -  RDA  **Continued to March 8, 2012 @ 7:00**- RDA

7:18    Michelle Greenfield  **43-2691**    (27 Keel Way) Construct minor additions to dwelling and garage.  Remove part of existing deck and gazebo and replace with a patio.  Enlarge deck on right side with additional sona tubes.  Remove basketball court and replace with plantings.  Fill in existing pool with clean sand - NOI  **Continued to March 22, 2012 @ 7:00pm**

[31:40]  Tom Quinn is representing the homeowner and explains that they are requesting hardscape/landscape changes to the property with some small additions to the home.  They would like to remove a paved basketball court and a generator and there is a pool that they would like to clean out and fill with sand instead of removing it so that they leave the possibility of future use.  Mr. Quinn also states that there is an existing deck with approximately 34 or 36 footings that will be removed and replaced with a patio at grade.  The patio will be a masonry patio a little bit smaller than the existing deck.  They would like to square off the house in the back and bring out the front door area.  There are two trees; one of which is dead and the other is hanging over the house that they would like to remove.  They will remove a chain link fence that goes around the entire house and will be including a small mitigation area in the rear corner of the property along with additional plantings in the front yard.  Agent McManus informs Mr. Quinn that the entire property is within Land Subject to Coastal Storm Flow so a planting plan is required and also the specifics of the seed mix for any proposed grass areas.  Mr. Quinn states that the little strip in the front is the only grass on the entire property.  Mr. Cook asks about a 3’ platform and Mr. Quinn states that they can build a wooden step right off the foundation onto the patio.  Mr. Sweet states that there are a lot of open issues in regards to the landscaping and decking and suggests a continuance until a firm plan is submitted.  Mr. Quinn is unsure of what else can be submitted and Mr. Sweet states that a planting plan or some type of plan for the areas of the removed basketball court and pool.  Mr. Quinn presents a plan that the ARC has approved and Agent McManus questions why it was not submitted with the application.  The Agent recommends a continuance and requests a more detailed narrative.

  • Santuit Pond Preserve Committee (Kris Clark-LAPC) – This land bank which is roughly 300+ acres and has land stewardship coverage was supposed to be managed by a committee of representation from Barnstable, Mashpee and Division of Fisheries & Wildlife.  There was never really a plan created but Kris Clark with the Land Acquisition and Preservation Committee with the Town of Barnstable has been working with the Town of Barnstable to organize a management committee.  Mr. Sweet spoke to Jaci Barton who is the Executive Director of Barnstable Land Trust and she told him that there needs to be a management plan created as there are lots of lands on the east side of Santuit Pond. Agent McManus states that he only checks the herring run and checks the dam which will soon be a huge project that comes before the Commission under a Notice of Intent this year for a major reconstruction of the existing dam as it is currently under a state of failure.
  • By-Law And Regulations Review – Agent McManus has been reviewing all the pages in the regulations and noticed a lack of language.  He would like to meet with the Regulatory Subcommittee soon with a clear and concise agenda to discuss the recommended language changes, omissions, additions and updates to the existing regulations.
