Executive Session

Present: Vice Chairman Ralph Shaw, Brad Sweet, Mark Gurnee, John Rogers
Staff Present: Conservation Agent - Drew McManus / Administrative Secretary – Kris Carpenter
The Executive Session commenced at 7:40pm to discuss the pending fine and possible litigation for Warren Fields.
The Agent states that he met with Town Council on March 23rd and informed them of the results of the Executive Session from March 10, 2011. They felt at that time that Mr. Fields would not go higher than $1500 but will still represent the Commission as to how it was voted on.
Mr. Costello, Town Counsel, called Agent McManus this afternoon to inform him that Mr. Fields has offered $3000 and it was recommended to settle. The Agent was advised that if this case went to court, most likely it will focus on environmental issues and Concom may end up with nothing. Agent McManus also recommends that the $3000 should be accepted and also states that Mr. Fields is willing to come before the Conscom to answer any questions. Vice Chairman Shaw states that he does not see a need for Mr. Fields to come in. Mr. Sweet mentions that possibly including a “gag” order statement on the paperwork that will be signed so that Mr. Fields does not mention the proceedings to the press. Vice Chairman Shaw agrees that Mr. Costello should be asked what the legality is to add this type of verbiage to the
settlement paperwork.
Motion made, seconded and unanimously carried to accept offer from Mr. Fields to pay $3000 in fines with a request to Town Council to add appropriate wording to settlement
Motion made, seconded and unanimously carried to exit Executive Session at 7:55pm.
