Pre/Post Hearing Agenda:
- Minutes: Approval of the following minutes: Thursday, August 5, 2010
Motion made, seconded and unanimously carried to approve the minutes of August 5, 2010.
- Quashnet Bogs Meeting Date: Update on meeting with AFCEE for the Quashnet Bogs and Quashnet River rehabilitation; the set date is September 24, 2010 in Conference Room 3. Doug Allen from Haley & Aldrich, Mike Minior from AFCEE, Agent McManus and possibly some or all of the Commissioners will be present.
- Mashpee Pine Barrens Conservation Lands: Update on the proposed fire breaks and road widening; Chief Baker had explained previously that there was another phase in the roadside clearing and creation of a buffer zone in the Mashpee Pine Barrens area. It is an extension of the work that started along Great Hay Road through Jehu Pond in the Mashpee Wildlife Refuge system. Also there will be some understory treatment of which a 100’ buffer zone will be created around Polaris Drive and the other communities that abut Mashpee Pine Barrens. This will be similar to the project at the Mashpee River Woodlands last year and the funding is all through federal wildfire money. Maintenance will be included which will be conducted every two-three years. A meeting will be held with the Greenwood
Association that abuts the area due to a lot of questions and concerns from the residents. Agent McManus will set up a meeting with Chief Baker to come in and clarify or answer any questions that the Board may have.
- Regulation 27: Docks & Piers; Final comments for the proposed regulation; Mr. Gurnee had submitted a few comments in regards to some of the subject matter in the proposed Regulation 27 (sunlight penetration/planking space and float sizes). The Agent would like to schedule one more subcommittee meeting to go over these questions and then try to finalize the regulation. Chairman Fitzsimmons has requested one last look before it goes out to the public which the Agent agrees and also mentions an “expanded” subcommittee meeting for any other comments.

7:09 Town of Mashpee SE 43-2616 (Popponesset Bay) Dredging of 1916 Channel NOI
Resource Area:
Peter Sullivan from Sullivan Engineering explains that this is a straightforward project and proposes maintenance dredging of the 1916 Channel in the Popponesset Bay and to place the dredge spoil as beach nourishment on Popponesset Spit Barrier Beach. There is a two fold public benefit to this project; one being for navigation through the channel and the second is the beach nourishment to improve Popponesset Spit. The Channel is 1750’ long and 50’ wide and a controlled depth of -5’ with a proposed 1’ over dredge. This will produce approximately 10,000 cubic yards in clean sand dredged material. 70% of the channel is owned by the Town of Barnstable and 30% is the Town of Mashpee. Last week, the Barnstable
Conservation Commission approved the project contingent upon receipt of comments from their Shellfish Agent and also receipt of the MESA determination (which was received about 3:30pm today). Agent McManus asks how long does the maintenance permit last. It is defined as to how it is licensed with the Commonwealth. Chapter 91 will issue a permit with a 10 year term in which you can dredge anytime within that 10 year period. The Army issues a permit as a category 1 or category 2 and their conditions are tied to that. Mr. Gurnee asks how they know what the spoil material is and Mr. Sullivan states that they have taken material samples and had them tested and it is clean sand. Agent McManus mentions that Division of Fisheries & Wildlife and Natural Heritage and Endangered Species have signed off on the project with very specific conditions including time of year restrictions. Chairman Ken Bates (Chairman of the Waterways Commission) states
that every member of the Waterways Commission is in favor of this project and explains that the funds were budgeted at May’s town meeting.

7:12 David & Ana Ferris SE 43-2618 (24 Seconsett Point Rd.) Construct ramp, pier & float in Little River NOI
Resource Area: Land Subject to Coastal Storm Flow, Land Under Ocean, Salt marsh
Jack Vaccaro from Vaccaro Environmental Consulting is representing the homeowner and states that this project is for a dock that would extend a little over 100’ into Little River across the saltmarsh. The dock would extend from the house by way of an elevated walkway where it crosses over the saltmarsh; it would go up a set of stairs to a more elevated section of the dock that would allow 5’ of clearance between the elevation MHW and the bottom of the dock. It would then extend out another 80’ to the end of the saltmarsh where a ramp would extend out to a float. The dock will be constructed and installed by barge during high tide through the saltmarsh with pilings being quickly driven in.
Agent McManus explains that this is a straightforward project and the planking gives 70% sunlight. The Harbormaster and Shellfish Warden have both signed off and there were no concerns with Natural Heritage.

7:15 Scott Murray SE 43-2615 (21 Squaw’s Lane) Demo/Rebuild NOI
Resource Area: Land subject to coastal storm flow, coastal bank and coastal dune
Jack Vaccaro from Vaccaro Environmental Consulting mentions that at the last hearing there was a lengthy discussion about the proposed structure and how it would be closer to the top of the coastal bank. They have since revised the plans and have moved the proposed house back but will be keeping the same mitigation plan which is over 2000 squ. ft. Agent McManus comments that it was nice to see the owner being co-operative with the set back adjustment and yet still offering the same mitigation as previously proposed.
