Commissioners:  Chairman Jack Fitzsimmons, V. Chairman Ralph Shaw, Brad Sweet, Mark Gurnee, Lloyd Allen, John Rogers

Staff Present:  Drew McManus (Conservation Agent) and Kris Carpenter (Administrative Secretary)

Call Meeting To Order:  6:30 pm

Chairman Fitzsimmons asks for a motion to hold executive session for the purpose to discuss Mr. Field’s fine / pending litigation situation and states that the regular session will follow immediately at the close of the executive session.  The Board complies with a roll call in which all unanimously agree.

7:00    Kathleen Power (2 Deans Hollow Road) Replace failed septic with Title V - RDA
        Resource Area: LSCSF
        Material submitted: Sewage Disposal System 11/09/10 Warwick & Associates; Site Plan 10/25/10 Warwick & Associates       
        Jack Landers-Cauley represented the homeowner and is working with Warwick & Associates.  He explains that it is a failed system that needs to be upgraded.  It will be put on the highest part of the lot and will need a pump.  The tank in the back yard has two chambers.  Board of Health has application and is under review.

Motion made, seconded and unanimously carried for a Negative Determination

                
7:03    Evelyn Burke (44 Lisa Lane) New title V System – RDA    Cont’d from December 2, 2010
        Resource Area:  Isolated Land Subject To Flooding/ Vernal Pool
        Material submitted: Septic System Repair Plan 11/11/10 Darren Meyer; Proposed Septic System Upgrade 11/11/10 Darren Meyer
        Darren Meyers represented the homeowner and proposes to eliminate a failed title V system in the rear of the property by replacing the tank & pump in the rear and a new leach field in the front of the house.  At the last hearing, the Health Inspector had a comment regarding the plumbing and if it could be rerouted to the front yard.  Mr. Meyers says it is not feasible to reroute it.  He has received a letter from BOH approving the plan.  Agent McManus confirms that the letter is from the Board of Health requesting a variance and had approved plans with conditions.

7:06    Stephen & Constance Goulet SE 43-2637  (207 Monomoscoy Road) Demolish / Rebuild new single family 3-bedroom home with attached garage - NOI
        Resource Area:  Flood zone A
        Material submitted: Proposed Site Plan 12/03/10 JC Engineering; Site Development Plan 12/14/10 John Priestley, Jr.
        Tom O’Rourke from Capewide Enterprises represented the homeowner and is seeking approval to complete a project that involves the tear down of a single dwelling home and the construction of a new single dwelling home with site work and utilities. The site work includes the removal of trees.  Agent McManus made a recommendation for some plantings for the tree removal although mitigation is not required.  The agent asks of grade changes and Mr. O’Rourke states there are none.  Some of the trees being removed are heavily infested with bark beetles which pose a hazard to the existing house.  Driveways will be pervious with crushed stone.  Mr. Allen asks if the house will be elevated and Mr. O’Rourke states that the house will be approximately 6” higher than the existing house.  Mr. Gurnee asks about the existing septic and Mr. O’Rourke responds that the septic has been inspected and it passed.  Agent McManus reads the comments from BOH which show that no application review is necessary.

7:09    William & Sarah Sullivan (180 Daniels Island Road) Various hardscape and landscape improvements to pool area – RDA
        Resource Area:  Buffer to coastal bank/ LSCSF
        Material submitted: Proposed Landscaping 11/15/10 Cape & Islands Engineering
        Jack Vaccaro from Vaccaro Environmental Consulting represented the homeowner and explains the work being proposed.  The work proposed by the Sullivans is all within an existing fenced pool area and consists of the following: Removal of the timber retaining wall that was originally installed in 1991 and replace with a masonry wall along the pool edge (same footprint); install a 5” wide drainage strip along the pool perimeter to promote infiltration; install a fire pit at the northern part of the pool; relocate two gates and associated steps at two locations; there will be a need to reconfigure the egress off the rear of the house; large deck on the rear of the house will be removed exposing a large area where they would like to do some plantings and install more blue stone patio; remove some Junipers from the slope and plant more desirable native plants; extend the pool perimeter fencing because of the changes to the egress.  Agent McManus states that there is no effect to the coastal bank or adverse impact to any of the resource areas.  All changes are within a pre-disturbed layout.  Removal of the non-native Junipers is fine as there will be no impact.  Mr. Gurnee asks if patio is pervious and Mr. Vaccaro states that they are using large blocks so that is why there will be a drainage strip installed

  • Minutes:        Approval of the following minutes:  Thursday, December 2, 2010
The Chairman mentions that the newspaper had quoted a comment from Mr. Fields and suggests that this particular comment should be included in the minutes.  Ms. Carpenter responds that she would like to listen to the taped meeting to confirm the exact wording.

  • Administrative Review:  418 Quinaquisset Avenue / Cotuit Bay Condos SE 43-2554 - Vista pruning corridors
John Slavinski from Cape & Islands Engineering explains that instead of the two 50’ corridors they would like to change it to four 25’ corridors.  Agent McManus comments that normally for a single family dwelling it would not be approved but circumstances are different for condos.

Motion made, seconded and unanimously carried to approve the Administrative Approval for SE 43-2554


Updates:

  • Updates on gates/access: Jehu Pond - Retrofitting housing units over lock/pins on four existing gates- Capeway Welding – Agent McManus explains that he met with the owner of Capeway Welding who was referred by Catherine Laurent.  He has not been able to get in touch with the company that originally installed the gates.  There are four gates that he would like to retro fit with housing units over the lock & pin to make it inaccessible to bolt cutters.  Capeway Welding will provide a quote which will be submitted at the next hearing and it then can be voted on for approval.  V. Chairman Shaw asks if it is needed to get other bids and the Agent confirms that he can but usually projects are sent out to bid when $1000 or more.  Mr. Sweet asks of additional gates at Jehu Pond and Agent McManus says that he spoke to Tom Eagle who is the Federal Partner at Jehu from US Fish and Wildlife who stated that they do not have the funds currently to purchase more gates.  The Agent states that if we want gates at those two locations then Concom will have to pay for them which the funds are available.  He mentions that he can get a few estimates but a gate at Amy Brown should also include signs that state “not a thru-way” at both entrances.  Mr. Sweet mentions that maybe DPW can create a turnaround but the Agent would rather see no intrusion into the woods.
  • Wildfire clearing update: Mashpee Pine Barrens/Great Hay/ Holland Mills - The Agent went out with Chief Baker and Tom Eagle from US Fish and Wildlife and everything is going according to plans regarding the 100’ buffer.  Mostly understory clearing and a small section where they took trees that was 6” circumference or less which is letting more sunlight through and trappings for the New England Cottontail.  Mr. Sweet asks how often Chief Baker will need to go back in to maintain these areas and Agent McManus states that the consensus is approximately 2-4 years on a rotating basis between all areas.
  • Update on refuge clean up day 1/12/11 - The Mashpee Natural Wildlife Refuge Partnership Group will be hosting a refuge clean up day on January 12th.  They will meet at the Waquoit Bay Reserve at 9am and then go to Jehu & Johns Pond mostly to clean up trash.  DPW has opened up the transfer station for all forms of trash that day.  Only man made trash will be picked up.
  • Update: Americorps seasonal position: Land Stewardship Program – The Agent will be applying for a seasonal position requesting someone from Americorps to come in and work for Concom two days a week to get the Land Steward Program up and running as it should be.
