Commissioners Present: Ralph Shaw (Chair), Cass Costa, Jeff Cross, Len Pinaud, Lloyd Allen, and John Rogers
Staff Present: Steven Solbo, Conservation Agent
Chairman Ralph Shaw called the order at 6:55 p.m.
PUBLIC COMMENTS: None
POST HEARING AGENDA:
1. Regulation Sub-Committee: Steve brought up the fact that it has been a long time since the Commission sat down and looked at the regulations for possible changes/tightening, particularly needed is a Regulation, or Policy Guideline on Construction Methodology. Jeff Cross then brought up the issue of Dock/Pier guidance, and all agreed that a meeting was needed. Steve mentioned that we should wait for Jack to get back to decide on a time, a date and a location. Commission agreed, and Jeff Cross offered up his house as a location so that we could all watch his Osprey’s for inspiration.
2. General Description/Advertisement Requirements: In light of the Cook project on the April 5th docket, it was recommended that the Agent look into the possibility of already existing requirements for what is listed as a general description/advertisement. All agreed that this is something that needs to be looked at, more of a service to the general public and abutters than anything else.
3. Minutes of the March 8th and February 22nd meetings were approved.
7:00 PM – Bonnie Smith, 266 Monomoscoy Road (continued from 3/8/07) NOI Project has been withdrawn.
7:03 PM – Christopher Peacock, 7 Crow Road (construct an addition and two decks) NOI
Jack Vaccaro from Vaccaro Environmental Consulting represented the applicant. Stated that the project was to construct an addition and deck to within 27’ of the top of an Inland Bank, but that the area that the building was to occur was already disturbed. Steve agreed with Jack’s description and recommended issuing an Order of Conditions.
Motion made, seconded, and unanimously approved.
7:06 PM – Allen and Stephanie Bagg, 89 Sunset Circle (demo existing deck and rebuild new 29.5’ x 14’ deck) RDA
Allen Bagg was there to represent himself. Mr. Bagg stated that the project in question did not fall within the Commission’s jurisdiction. After consulting the plan, Steve agreed with that statement and wondered about the shed that was mentioned in the RDA. After a bit of confusion it was settled to allow Mr. Bagg to demo his shed, and reconstruct the shed in the same exact footprint. Steve then recommended a negative determination.
Motion made, seconded and unanimously approved.
7:09 PM – John and Maria Rousou, 90 Summersea Road, (install de-nitrifying Title 5 septic system) AOC
Mike Borselli of Falmouth Engineering represented the applicant. Mike explained how the septic went from functioning and working during the past application for the Rousou’s to failure. Lloyd Allen and Jeff Cross raised questions about how a septic system can be replaced in the same area as a failed area. Mike Borselli eased the concerns of Jeff and Lloyd, and the rest of the commissioners. Steve recommended closing and issuing an amended order of conditions. Jeff Cross abstained from the vote.
Motion made, seconded and unanimously approved by remaining 5 commissioners.
7:12 PM – Nancy and Richard Cook, 401 Monomoscoy Road (construct a pier that will extend 48 feet from the property line) NOI
Mike Borselli, or Falmouth Engineering, representing the applicant. Mike explained the project to the commissioners as a pier, ramp and float extending into Little River, also explained that the float will be 150 sq. ft. meeting the commissions standards on docks. Steve then told the applicant’s representative that the size of the boat at the dock would be ordered to be of certain specs. The boat at no point would draft more water than was available. Mike agreed. Steve recommended closing and issuing an order of conditions. Bob Valleta, an abutter to the project had concerns about how the project was advertised as a “Pier” rather than a “Pier, Ramp and Float.” A discussion about requirements of abutter’s notices ensued between the commissioners and
the agent. Mike Borselli said that he would re-notify all abutters on the project with more clarity and accept a continuance to April 19, 2007, @ 7:21.
Continued to April 19, 2007, @ 7:21 PM so abutters could be re-notified of project description.
7:15 PM – Burton Sack, 37 Shoestring Bay Road, (provide access to the pier and dock directly from his home via a proposed landward extension of the pier) AOC
Julie Conroy of the Horsley-Witten group, representing the applicant. Julie passed out pictures to all of the commissioners to show them the site from various locations and showing stakes to portray where the extension was going. Julie then went on to explain the project with plans/pictures. Steve then explained to Julie that as much effort as possible to make this structure passable for wildlife should be undertaken, the commission agreed, as did Julie. With that, Steve recommended that this issue be closed and an amended order of conditions be issued.
Motion made, seconded and approved, unanimously.
7:18 – Town of Mashpee DPW, Great Neck Road South (road layout), (8 foot sidewalk/bikeway extension) RDA.
Greg Taylor, Director of Public Works, Town of Mashpee, representing the town. Greg started off by discussing the basic premise of the project to the commission, simply stating that this project basically falls within the “right of way” layout and that they are lengthening the current bike path from Godfrey Rd. down to the Children’s Museum. All commissioners thought it was a great idea. Greg went on to explain that the project came within 100’ feet of resource area’s in a couple locations. The lengthening would end up being close to 3500 ft. Steve then said that the project was borderline exempt from the Act, due to the fact that the project basically fell within the road layout, therefore could be considered part of infrastructure of the town, thus making it a
limited project. Steve made the recommendation to issue a negative determination.
Motion made, seconded and unanimously approved to issue a negative determination.
After a brief discussion about boat trips with Jeff Cross and the rules of Public Meeting law, the meeting was recommended to be closed by Cass Costa. Lloyd Allen seconded, remaining commissioners agreed and meeting was adjourned.
