Jack Fitzsimmons called the meeting to order at 6:55 p.m.
Pre Hearing Items:
1. Administrative Approval SE 43-2423 (26 Little Neck Lane)
John Graci (contractor) submitted an administrative request to increase the height of the retaining wall on the left side of the property at 26 Little Neck Lane. Presently the retaining wall in place does not match the grade of the coastal bank that has been disturbed as a result of house construction. The wall is to be raised by 1 foot in height, then backfilled and planted with bearberry for erosion protection.

Hearing Agenda:
7:00 p.m. Marie Viita, 18 Little Neck Lane (Install Title V Septic System-RDA)
John Doyle (contractor) represented the applicant and described the project. The agent conditioned that silt fence and hay bales be used because of the location of the project to the nearby resource areas (coastal bank on both sides of house). The contractor agreed to put hay bales and silt fence in place. The agent recommended approval.

7:03 p.m. Blanche Pozerski, 83 Whipporwill Circle (permit existing pier-ATF NOI)
Rob Braman (Braman Engineering) represented the applicant and described the proposal. Cass Costa recused herself from the hearing. Mr. Braman described the history of the project to the commission. The existing pier was denied permitting by the Town of Mashpee back in the early 80s; however the pier was issued a superseding order of conditions from the DEP. The applicant is now seeking permitting of the existing pier through the town of Mashpee; however, information on file with DEP and Mashpee did not match what is existing in terms of proximity of pier to the house as well as the dimensions and associated pilings (ramp and float shown on old plans; however, they were never installed). New plans were submitted accurately reflecting what exists. Marine Fisheries Service had sent in a
letter of concerns and/or recommendations for the existing pier. Rick York (Mashpee Shellfish Warden) submitted a letter stating his approval of the existing pier. The agent recommended approval.

7:06 p.m. Town of Mashpee DPW, Quinaquisset Avenue (Drainage improvement in right of way- NOI)
Norm Hayes (BSC Group) represented the applicant and described the project. The project involves the replacement of 3 old drainage systems with new bio-retention systems along Quinaquissett Avenue. Additionally, accumulated road runoff (sediments) will be removed from a previously existing wetland in the Mashpee River Woodlands Conservation Area which lies just below grade of an old storm drainage area. The agent inquired as to the methodology for removal of sediments from the area and Mr. Hayes told the agent most of the removal would be done by hand; however some removal by machine may be necessary and all necessary precautions will be taken to ensure a minimum amount of disturbance to the existing vegetation. The agent recommended approval.

7:09 p.m. John’s Pond North Cove Beach Association, Shorewood Drive (Add sand and return the beach to the prior profile of the land- RDA)
A North Cove Beach Association member represented the applicants and described the project. The project calls for the placement of approximately 20 yards of sand on to North Cove Beach at John’s Pond. The agent conditioned that the sand is to be clean and grain size compatible. The sand is to be purchased from P.A. Landers. The agent recommended approval.

7:12 p.m. Janet and Barry Krock, 4 Cross Street (demolish and rebuild a single family residence- NOI)
John Slavinsky (Cape and Islands Engineering) represented the client and described the project. The project involves a tear-down/ re-build on a property that is within the flood zone as well as buffer zone to coastal bank. The footprint is to be increased slightly from what is existing. The agent asked about existing vegetation in the backyard facing the water that was not shown on the engineered plan. According to the plan, a patio is to be enlarged from its current footprint and this would necessitate the substantial removal of existing vegetation. Because neither the vegetation nor any mitigation measures or landscape plan was shown or submitted, the agent recommended a continuance until the aforementioned information is submitted in accordance with the requirements for Notices of Intent.
The representative agreed.

7:15 p.m. John McCarthy, 5 Squaw’s Lane (demolish and rebuild a new single family residence with associated appurtenances- NOI)
John Slavinsky (Cape & Islands Engineering) represented the applicants and described the project. Mr. Slavinsky stated that one of the reasons for the re-build is to meet set back requirements from the road for the “Popponessett overlay”. The entire yard is previously disturbed and no removal and/or alteration of existing vegetation (other than lawn) will be necessary. The agent recommended approval.

7:20 p.m. Ronald Bonvie, 3 Southport Dr. (construct 67 condominium buildings- 256 units- NOI)
Amy Ball from Horsley Whitten Group represented the applicant and described the project. Commissioner Lloyd Allen withdrew from the hearing. The condo units are being constructed in the buffer zone to a contiguous inland bank bordering Martha’s Pond in the Southport Condominium complex. Amy Ball informed the commission that hundreds of trees were flagged over a 2 week period for the purposes of identifying trees over 5” in caliper. A paved walking path running along the units is also part of the proposal. Mr. Bonvie described the construction methodology of the condo units. The units are to be constructed in such a way that the porch/decks of these units are extensions of the foundations and thus eliminate the need for retaining walls and back fill which would require more disturbance
to the buffer zone. Additionally, each unit has been designed to be long/narrow rather than wide for the purposes of less overall disturbance to the resource area (more units/ less disturbance). The agent will accompany members of the planning board as well as engineers and consultants on a walk through of the proposed area for the purposes of ecologically sound construction practices and saving old growth trees. Certain areas of the proposed walking path are in very close proximity to wetlands and the agent recommended that these areas of the path be non-paved (stonedust/gravel, to be used) to prevent sediment runoff into the wetlands. The agent recommended approval.
