Commissioners present:  Jack Fitzsimmons, Chairman, Michael Talbot, Vice Chairman, Len Pinaud, Clerk, Cass Costa, Jeffrey Cross, John Rogers and Ralph Shaw.

Staff present:  Drew McManus, Assistant Agent, and Frances Wise, Board Secretary

Jack Fitzsimmons, Chairman, called the meeting to order at 6:55 p.m.

Public Comment:  None.

Non-Hearing Agenda

Old Business:  None.

New Business:  

1.  RFAA SE 43-2335, 29 Shoestring Bay Road, Robert Lurie.  Amy Ball represented the applicant and described the project.  Michael asked if there is any opportunity for any vegetation to be planted that would survive underneath the platform. Mrs. Ball thinks there would be.  Drew didn’t see any problem with the project.  Michael said we have been trying consistently to maintain 4 ft. docks.  The only significant change he sees is that originally the structure was going to be above the salt marsh, and now it’s on the coastal bank, so he is asking for an agreement that there be as much revegetation underneath the structure as possible, and that this be notated on this administrative approval.

Motion made, seconded and unanimously carried to approve SE 43-2335 per the above.

2.  RFAA SE 43-2359, 318 Redbrook Road, Gerry Graves.  Drew described the plan and recommended approval.  Although a silt fence is shown on the plan, Michael recommended putting in a double haybale line or the equivalent to be on the safe side.  

Motion made, seconded and unanimously carried to approve SE 43-2359 with the condition that there be a double haybale, staked silt fence line instead of a single silt fence line.

3.  RFAA SE 43-2414, 132 Shore Drive West, Gerald Segal.  Drew described the plan.  Jack queried the placement of the walkway, and Drew will check it out.

4.  DEP File 05-3, Sea Quarters Condos, Phase I.  Cass stepped down for this hearing.  Drew described the plan.  Michael’s principal concern is the erosion potential in the New Seabury area.  He suggested providing some sort of temporary erosion control, and we need to have a management protocol.  Regulation #12 (Mitigation) states that there has to be a three-year management plan. The Regulation does not permit replacement of trees and shrubs with season grass meadows without our approval.  We need to know what’s there now.  What is being replaced has to be comparable to what’s there now or they have to come to us for approval.

5.  Mashpee DPW request.  Drew said the Mashpee DPW is requesting approval to continue to clean up the public portion of the South Cape Beach.

Motion made, seconded and unanimously carried to approve the request for this administrative approval by the Mashpee DPW to continue the beach raking and grooming program of South Cape Beach with the understanding that they follow our already approved protocol and it be properly managed.

6.  Vernal pool certification (NHESP 3978, WBNERR jurisdiction).  Drew said the Massachusetts Division of Fisheries and Wildlife has notified us that a vernal pool under our jurisdiction has been certified.  Steve and he have not had an opportunity to check out the location.

7.  Boston University student.  Drew said this student was doing a paper on wetlands, Steve and he helped her on information on the Wetlands Protection Act, and she wrote a thank-you note for their help.

8.  WBNERR training seminar on 5/16/06, 10 a.m. to noon.  Drew said Waquoit Bay is having this seminar for anybody interested.  Drew will attend.

9.  Approval of minutes for 4/6/06.

Motion made, seconded and unanimously carried to approve the minutes for 4/6/06.

Hearing Agenda

7:00 p.m., Robert Stow, 25 Monomoscoy Road West (continued from 4/6/06).  John Slavinsky represented the applicant.  He requested a continuation because he is awaiting a reply from ACEC.

Motion made, seconded and unanimously carried to grant a continuation to June 8th at 7:00 p.m., at the request of the applicant.

7:05 p.m., John Salvadore, 108 Fells Pond Road (construct 4 ft. wide pathway with landscape timber steps, maintenance of the existing pier, and minor grading/clearing of shrubs). Jack reclused himself from this hearing.  Brad Holmes represented the applicant and described the plan.  Michael said there is an outstanding tax bill on this property, so we can’t conduct this hearing tonight.   

Motion made, seconded and unanimously carried to grant a continuation to May 25 at 7:35 p.m., at the request of the applicant.

7:10 p.m., Daniel Bohnenberger, 43 Riverside Road (construct 26x26 ft. garage with storage above).  Mr. Bohnenberger described the plan.  Drew recommended approval.

Motion made, seconded and unanimously carried to approve this RDA.

7:15 p.m., Dwayne Draggoo, 95 Bayshore Drive (install gunite in-ground swimming pool).
Mr. Draggoo described the plan.  Michael requested that a tree be planted to replace the one being cut down.  He also requested a revised plan showing the fence location and a silt barrier line to prevent the concrete from washing into the naturally vegetated areas.

Motion made, seconded and unanimously carried to approve this RDA pending receipt of a revised plan showing the fence location and a silt barrier line to prevent the concrete from washing into the naturally vegetated areas.

7:20 p.m., Alberto Velella, 407 Monomoscoy Road (continued from 4/27/06). John Slavinsky represented the applicant and described the revised plan.  He said they have removed about 800 sq. ft. of grass and there will be a berm where the old railroad track was.  Jennifer Malila described the planting plan.

Motion made, seconded and unanimously carried to approve this AOC.

7:25 p.m., William and Jeanne Garvin, 9 Surf Drive (construct new screen porch with a small deck, and replace sono tubes).  Mark Casoli represented the applicant and described the plan.  Drew recommended approval

Motion made, seconded and unanimously carried to approve this RDA.

7:30 p.m., Babette Liebman, 86 Summersea Road (amend landscape plan).  Tom Jalowy represented the applicant and described the plan.  He said he met with Steve and Drew at the site and more recently with Michael.  An erosion problem will be remedied by putting some fieldstone into the embankment and planting some bearberry and Pennsylvania sedge there.  Michael said that Michael Grotzsky had talked about a hedge of white pine, but white pine will not grow over the huge leaching tanks, so the change here is planting red cedars and bearberries instead.  Michael agreed that a leaning tree is hazardous to the house and approved its removal.
