Commissioners present:  Cass Costa, Ralph Shaw, Jeffrey Cross, and John Rogers.

Staff present:  Steve Solbo, Agent, and Frances Wise, Board Secretary

Ralph Shaw called the meeting to order at 6:55 p.m.

Public Comment:  None.

Non-Hearing Agenda

Old Business:  None.

New Business:  

1.  RFAA SE 43-1696, Aquatic Nuisance Control.  Steve notified the members that this annual water purification treatment will begin on June 26, 2006.

2.  Ralph asked that the records show that John Rogers will be voting at this meeting in order to have a quorum.  Jeff expressed thanks to Cass for attending this meeting in order that the Commission would have a quorum, in spite of the fact that she is still recuperating from a virus.

3.  RFAA SE 43-2301, Edward Kodinsky, 85 Timberlane Drive, Steve said the owner wants to make some changes to his deck, and he recommended approval.

Motion made, seconded and unanimously carried to approve SE 43-2301.

4.  RFAA SE 43-2417, Thomas Cimeno, 29 Frog Pond Close, Steve described the project and recommended approval.

Motion made, seconded and unanimously carried to approve SE 43-2417.

5.  RFAA SE 43-2142, Willowbend, 69 Shoestring Bay Road, Steve said they reconfigured the lots, the work limit remains the same, and the change has no affect on us.  He recommended approval.

Motion made, seconded and unanimously carried to approve SE 43-2142.

6.  Jeff commended Steve for his excellent job performance, and all agreed.

7.  Approval of minutes for 5/25/06.

Motion made, seconded and unanimously carried to approve the minutes for 5/25/06.

Hearing Agenda

7:00 p.m., Jim Quigley, 376 Monomoscoy Road (construct and maintain an 8x24 ft. front porch with steps).  John Slavinsky represented the applicant and described the project.  Steve recommended approval.

Motion made, seconded and unanimously carried to approve this RDA.

7:05 p.m., Robert Stow, 25 Monomoscoy Road West (continued from 6/8/06).  John Slavinsky represented the applicant.  Steve said that due to the fact that this is a very touchy situation, the plans have been resubmitted showing the mean high water.  However, because we do not have the commissioners here this evening who were present for the previous discussions, he recommended a continuation.

Motion made, seconded and unanimously carried to approve a continuation to 7/6/06 at 7:20 p.m., at the request of the applicant.

7:10 p.m., David Bazerman, 50 Cayuga Avenue (continued from 6/8/06).  Mr. Bazerman was present.  Steve said we had no problems with this plan at the previous meeting, but we did not have Natural Heritage’s comments.  We now have their confirmation that this project has no adverse effect.

Motion made, seconded and unanimously carried to approve this NOI.

7:15 p.m., Robert Pace, 26 Little Neck Lane (continued from 6/8/06).  Jack Vacarro and Jennifer Malila represented the applicant.   Mr. Vacarro reviewed the plan and said that at the last meeting the members expressed concern about the fact that a portion of the deck extended 5 ft. into the buffer zone.  They have now reduced 120 sq. ft. in that zone to 80 sq. ft.  The only portion of the new house that extends beyond the original house is a triangle that amounts to about 15 sq. ft., which will be on a sono tube. Ms. Malila described the planting plan. Steve recommended approval.

Motion made, seconded and unanimously carried to approve this NOI.

7:20 p.m., Town of Mashpee DPW, Riverside Road, (remove and replace existing ramp/roadway with a new structure). Catherine Laurent represented the applicant and requested a continuance.

Motion made, seconded and unanimously carried to approve a continuation to 7/6/06 at 7:25 p.m., at the request of the applicant.

John Rousou, 90 Summersea Road (demolish/build new house—reopen and close due to wrong abutter notification).  John Vaccaro represented the applicant and described the new plan.  Steve said we closed this hearing at the last meeting, but the wrong abutters had been notified in error.

Mike Gutman, an abutter on the north side on lot 43, said the plan shows trees on the south side of the house, but only one tree is shown on the north side.  He said there are in fact 11 trees, all 6” in diameter or larger.  Three of those trees are inside the work limit, four are on the work limit, and four are outside the work limit.  His question was what is the disposition of those trees.  

Steve said any trees inside the work limit will be taken down.  He counted six trees shown on the landscape plan, and he said they should also be shown on the engineered plan.  If those trees are injured, they plan to replant.  Mr. Vacarro said any trees outside the work limit will be preserved, but if they are disturbed, they will be replaced.  Steve confirmed that the best effort will be made to preserve the trees, and he was sure that there will be a qualified arborist on the site.  

Mr. Gutman wanted to know if the four trees on the work limit line are going to be preserved or removed.  Mr. Vacarro said those trees are going to be preserved.  Cass recommended that they revisit the site to see where those four trees are and make sure that they are on the landscape plan.

Motion made, seconded and unanimously carried to approve this NOI pending receipt of an updated landscaping plan showing the trees discussed above.
