Commissioners present: ~Jack Fitzsimmons, Chairman, Ralph Shaw, Vice Chairman, Len Pinaud, Clerk, Jeffrey Cross, and John Rogers.

Staff present:~ Drew McManus, Assistant Agent, and Frances Wise, Board Secretary.

Jack Fitzsimmons called the meeting to order at 6:55 p.m.~

New Business:~
~
1.~ RFAA SE 43-2314, 53 Pickeral Cove Road (Belekewicz).~ Drew described the project and recommended approval.
~
Motion made, seconded and unanimously carried to approve RFAA SE 43-2314.
~
2.~ Cape Cod Cooperative Extension Grant.~ Drew said we got a grant of $5,050 to purchase a gate for Conservation land.~ DPW has committed to $1,400 in services for this project.
~
3.~ Cape Cod Jeep Club.~ Drew said there was a meeting at Waquoit Bay with a representative from the Jeep Club attended by Steve and him, representatives from the Mashpee Wildlife Trust, the Orenda Wildlife Trust, and Massachusetts Division of Fisheries and Wildlife.~ The purpose of the meeting was to hear how the club might help clean out some of the areas in Conservation land.~ There is the possibility of opening up the sand pit area to the club for special events once or twice a year, and in exchange they would do some pretty heavy cleaning.~ Drew said they made it crystal clear that their offer to do some heavy cleanup does not guarantee any type of reciprocal action on our part.~ Drew said the club representative was a nice guy and understood that.~ The next step is for the parties of interest to attend a Cape Cod
Jeep Club meeting in Yarmouth in the near future to get a better feeling of what it’s all about and take it from there.

4.~ New Natural Heritage Endangered Species Habitat map.~ Drew said we just got this map and they have expanded their territory quite a bit.~ It looks as though all of New Seabury is under their jurisdiction.~

5.~ Approval of minutes for 8/31/06

Motion made, seconded and unanimously carried to approve the minutes for 8/31/06.

6.~ Runoff on Mashpee/Santuit Rivers.~ Jack asked if we have heard any more on this subject and the Rowley Report on Stormwater Runoff.~ Drew said all he knows is that we support the findings.~ Jack asked Drew to have Steve call him on this.
~
7.~ Proposed Mashpee nitrogen management plan.~ Jack said the Cape Cod Commission Report mentioned under Development of Regional Impacts (DRI’s) a Mashpee proposed nitrogen management plan.~ Jack hadn’t heard of any such plan before and he’s trying to find out who is doing it.~ Jack talked to Ed Eichner, a research scientist who works on the Cape Cod Commission, who thinks it is Tom Fudala.~ Drew will check with Tom and have him call Jack.~ Mr. Eichner told Jack that the Cape Cod Commission would be able to give technical assistance.

8. Falmouth Friendly Lawn program. Jack said he called Jack Barnes, who is on the committee that wrote the brochure for this program, and he sent Jack a copy of the brochure, which is very nice.~ Falmouth had money for the program from AFCEE.~ Jack said we didn’t get any money, and he doesn’t know why, but he thought we should be familiar with the brochure and asked Drew to show it to Steve.

7:00 p.m., Fran Reavey, 42 Cayuga Avenue (continued from 8/17/06).~ John Slavinsky represented the applicant and reported that the applicant has withdrawn this application.

Motion made, seconded and unanimously carried to approve the withdrawal of this application.

7:05 p.m., Don Houle, 71 Monomoscoy Road (remove existing cesspool, install new Title V septic system, and replace existing grass over system).~ John Slavinsky represented the applicant, and he and Drew described the project.~ Drew recommended approval.

Motion made, seconded and unanimously carried to approve this RDA.

7:10 p.m., Richard Casey, 104 Fells Pond Road (construct and maintain in perpetuity a stairway and dock).~ John Slavinsky represented the applicant. He said the applicant bought the property thinking that a dock and stairway was on his property, but found they are on his neighbor’s property, so he is filing to build a new dock and stairway.

Motion made, seconded and unanimously carried to approve this NOI.

7:15 p.m., James DeVincent, 122 Old Brickyard Road (continued from 9/14/06).~ John Slavinsky represented the applicant and described the project.~ Drew recommended approval.

7:20 p.m., Barbara Adner, 17 Bowsprit Point (3 ft. cantilever addition to a deck).~ No one was present to represent the applicant.~ Drew described the project and recommended approval.

Motion made, seconded and unanimously carried to approve this RDA.

7:25 p.m., Mark Smith, 106 Summersea Road (remove existing septic and install new Title V septic system).~ Drew recommended approval.

Motion made, seconded and unanimously carried to approve this RDA.

7:30 p.m., Jonathan Burtis, Riverside Road (continued from 9/14/06).~ John Slavinsky and Mark Burtis represented the applicant and described the plan. The applicant has agreed to comply with the Assistant Building Inspector’s requirement that 15 ft. of the present deck be removed.~ This portion of the deck will be replaced with a patio.~~

Motion made, seconded and unanimously carried to approve this RDA.

7:35 p.m., Thomas and Dale Choate, 43 Pickerel Cove Circle (demolish and rebuild new single family home with associated appurtenances).~ John Slavinsky represented the applicant and described the plan.~ Natural Heritage has not responded, but Mr. Slavinsky said the applicants will take their chances that they will not have any problem with the plan.~ Drew said if Natural Heritage has some minor concerns, the applicants can amend the order to address them.~ If their concerns are of a grander scope, the applicants would have to refile.~ If they have concerns, they would notify us by letter, and Steve or Drew would advise the applicants what they would have to do.~ Jack said in the past we have left it up to the applicant to make that decision.

Ellen Kagan, an abutter, read a letter written by her attorney objecting to any change in the house either by increased bedrooms or living area that would increase any usage of the home.~ Jack and Drew said that this is outside of our jurisdiction.~ Ms. Kagan understood that, but asked that the letter be in our files anyway, and it was agreed that we would do so.

7:40 p.m., Michael Trudeau, 79 Pickerel Cove Circle (add a 4 ft. wooden stairway to the water).~ John Slavinsky and Jennifer Malila represented the applicant.~ Mrs. Malila described the plan.~ Steve recommended approval.
