Minutes of April 7, 2005
Public Hearing
Mashpee Town Hall Meeting Room 1


Commissioners present:  Jack Fitzsimmons, Chairman, Michael Talbot, Vice Chairman, Len Pinaud, Clerk, and Lloyd Allen.
 
Staff present:  Bob Sherman, Agent, Steven Solbo, Assistant Agent, and Frances Wise, Board Secretary.

Jack Fitzsimmons, Chairman, called the meeting to order at 6:45 p.m.  

Public Hearing:  Bob distributed to the members 1) revised rules (under MGL.Ch 44, s. 53G) for hiring outside consultants, 2)  revised regulations for vista pruning, and 3) revised Reg. 25: Land subject to Coastal Storm Flowage for approval at this public hearing, and he described the changes made.  There was no public comment.

Motion made, seconded and unanimously carried to approve the revised rules (under MGL.Ch 44, s. 53G) for hiring outside consultants.

Motion made, seconded and unanimously carried to accept the additional language regarding regulations for vista pruning under Chapter 172.

Motion made, seconded and unanimously carried to approve the additional language in revised Reg. 25: Land subject to Coastal Storm Flowage, under Chapter 172.

Non-Hearing Agenda

Old Business:  

1.  RFAA-AFCEE.  Bob said we have a reasonable request from CH2Mhill/AFCEE to put in staff gauges in several wetlands.  He said no motion is necessary.

2.  AFCEE Cranberry Monies.  Bob said the transferal of monies approved in the minutes of 3/17/05 has been postponed to a Town Meeting in October.

3.  New Seabury Suit.  Bob said he has a notice from the Cape Cod Commission that there will be a hearing on  April 21st, 7:30 p.m. at the Mashpee Senior Center.  He guesses there has been a settlement.

4.  Summary of changes to WPA and regulations, courtesy of Nover-Armstrong Associates.  Steve said they did a good job of pointing out the changes made to the regulations.

5.  RFAA: SE 43-2329, 19 Sand Dollar Lane.  Steve described the changes requested and he recommended approval.

Motion made, seconded and unanimously carried to approve RFAA: SE 43-2329.

6.  Massachusetts Audubon Society.  Bob said they sent us their usual annual letter stating that they will continue to take measures to protect Pipings and Terns.

7. Regulations Sub-Committee.  A meeting was set for April 14th at 7 p.m. at Mike’s home.

8. Approval of Minutes for 2/3/05, 2/17/05 and 3/3/05.

Motion made, seconded and unanimously carried to approve the subject minutes.

7:00 p.m., Mute Swan Circle L.L.C., c/o The Beacon Co., 4 Mute Swan Circle (landscaping)  

Motion made, seconded and unanimously carried to approve a continuance to April 21st at 7:50 p.m., at the request of the applicant.

7:05 p.m., Lisa Drake, 413 and 417 Monomoscoy Road (demolish all existing structures, construct new home, utilities, septic, drainage, pool and landscaping.
Motion made, seconded and unanimously carried to approve a continuance to April 21st at 7:45 p.m., at the request of the applicant.

7:10 p.m., Cape Southport Assoc., LLC., 3 Southport Drive (maintain adequate drainage along wall behind housing units ).  Lloyd reclused himself from this hearing.

Motion made, seconded and unanimously carried to grant a continuance to April 21st at 8:30 p.m., at the request of the applicant.
7:15 p.m., Kenneth Jones, 29 Great River Road (continued from 3/17/05).  Dave Sanicki and Joe Bucchanio, landscaper, represented the applicant.  Steve and Mike cited a number of plantings that were unacceptable.  Mr. Bucchanio said the landscape architect did the plan and the applicant is willing to make any changes recommended by the Commission.  Mike said he will flag the species which should be changed, the applicant can submit a new plan and fax it to Mike, and request a continuation.

Motion made, seconded and unanimously carried to grant a continuance to April 21st at 8:35 p.m., at the request of the applicant.

7:20 p.m., Robert and Syrul Lurie, 29 Shoestring Bay Road (continued from 3/17/05).  Steve said we are still waiting for the coalescence of comments from DMF and the Shellfish Warden.  Bob said he’s spoken with these parties and we should have an agreement by the next meeting.  Also, he has provided these parties with suggestions for a more cohesive approach to this process and provided them with the rationale, but the decision is theirs.

Motion made, seconded and unanimously carried to grant a continuance to April 21st at 8:25 p.m., at the request of the applicant.

7:25 p.m., Mews Village Committee, Mid-Iron Way (continued from 3/17/05).  Larry Gray represented the applicant and described the plan.  Bob recommended approval.

Motion made, seconded and unanimously carried to approve the plan.
 
7:30 p.m., Punkhorn Realty, 80 Punkhorn Point Road (raze existing house/garage deck, and construct house, garage, decks, porches, swimming pool well, septic, landscaping).  Bob said he was at the site and the plan needs some changes.

Motion made, seconded and unanimously carried to grant a continuance to April 21st at 8:20 p.m., at the request of the applicant.

7:35 p.m., Dennis Williams, 10 Triton Way (add dormer, stairs, modify foundation and bulkhead).  Joel Fahnley represented the applicant.  Bob described the plan and recommended approval.

Motion made, seconded and unanimously carried to approve the plan.

7:40 p.m., George Harris, 33 Bearse Road (to propose a deck, walkway from the driveway to front entrance, and landscape the area with groundcover and bushes).  Mr. Harris was present.  Steve described the project and recommended approval.

Motion made, seconded and unanimously carried to approve the plan.

7:45 p.m., Willowbend Country Club, 95 The Heights (construct single family residence, driveway, utilities and landscaping).

Motion made, seconded and unanimously carried to grant a continuance to April 21st at 7:55 p.m., at the request of the applicant.

7:50 p.m., Willowbend Country Club, 95 The Heights (construct single family residence, driveway, utilities and landscaping).

Motion made, seconded and unanimously carried to grant a continuance to April 21st at 8:00 p.m., at the request of the applicant.
