Absent: Mary Waygan

                Meeting Called to Order by Chairman Halpern at 6:04 p.m.

                Motion made by Mrs. Buschenfeldt to approve the minutes of Tuesday,
                September 6, 2011 as presented.
                Motion seconded by Mr. Kaplan.

                OLD BUSINESS:

                Approval of Invoice for Payment:

The Community Preservation Committee was in receipt of an invoice from Town Counsel in the amount of $60 dated September 1, 2011 for correspondence with the Town of Barnstable relative to the disposition of the Mills Lands at Santuit Pond.

Motion made by Mr. O’Hara to approve the invoice payable to Louison, Costello and Condon PFAFF, LLP (Town Counsel) in the amount of $60 for legal work associated to the transfer of interest in the Mills Lands to the Town of Barnstable.
Motion seconded by Mr. Lord.
VOTE:  Unanimous.  8-0.

                Mills Family Lands – Update on Status of Land Transfer:
At their last meeting, the Board of Selectmen voted in accordance with the Annual May 2, 2011 vote of Town Meeting to petition for Special Legislation to permit Mashpee to transfer a partial interest in the Mills Family Lands to the Town of Barnstable.
To ensure the transfer of $150,000 in CPA funds, the Community Preservation Committee reviewed the language of the Town Meeting article.  As noted: All funds paid to Mashpee by Barnstable in consideration of this interest would be deposited in the Community Preservation Committee account from which the original purchase price was paid, and thus become available for appropriation for additional CPC Open Space expenditures.
As the article is written, it was agreed that funding would be returned to the Open Space Reserves of the Community Preservation Committee.  CPA funding from the Town of Barnstable is anticipated to be received by the Town of Mashpee in approximately one month.

COMMUNICATIONS & CORRESPONDENCE:
CPA Trust Fund Distribution:
It was noted the CPA Trust Fund Distribution is expected to be certified in mid- October.  Last year, the FY10 match was $322,883.
CPC Applications for May 2012:
The deadline for applications to be considered for the May 2012 Town Meeting is November 1, 2011.
