Notice is hereby given that a public hearing will be held on May 30, 2006 (Tuesday) in the Marlborough City Hall, 140 Main St.  3rd Floor, Memorial Hall, Marlborough, MA  at 7:00  P.M. on the petition of the below named person seeking variances/relief in the application of the Zoning Ordinance of the City of Marlborough, as follows:

St. Mary's of French Hill Redevelopment, LLC

The applicant proposes to develop 41 units of condominium style housing at the site of the former St. Mary's church.  Being Map 80, Parcels 61, 61A, 67 and 68 of the Assessors' Maps, also known as 29 Broad St.   The following areas of non-compliance with respect to zoning issues are:
·       As an administrative matter, the four lots depicted on the plan (DWG 12564-01.dwg) dated 3/21/2006, will need to be combined into one lot in order and an amended map and parcel reference assigned.
·       Lot coverage may not exceed 30% for residential uses in an RC Zone.  Your proposal shows 51% which exceeds the maximum allowed. (Chapter 200-43 and Table of Lot Area, Yards and Height of Structures - Chapter 200-41)
·       The maximum driveway grade for the first 15 ft. into the property may not exceed 3%.  Your proposal shows a steeper grade at 4.5%  (Chapter 200-49(B)(c)
·       In Zone B of the Water Supply Protection District, impervious area needs to be reduced at least 10%...Your proposal shows a 9.1% reduction, thereby not achieving the requirement.  (Chapter 200-24(F)(2b).
·       The plan does not show the type and location of durable curbing.  (Chapter 200-47(D)(7).
