Notice is hereby given that a public hearing will be held at 7:00 PM  in Memorial Hall, 3rd Floor, Marlborough City Hall, 140 Main St., Marlborough, MA  on April 9, 2013  on the petition of the below named person seeking an appeal as follows:

Petition:  Appealing the determination of the Building Commissioner that the destroyed building constitutes a stand-alone building; that the insurance policy views the loss as 100%, which supports the position that the building constitutes a stand-alone building; that under §650-12B(3) because the catastrophic loss is over 75% of the market value limit, compliance with current zoning is required; and that under §650-12B a special permit from the City Council is required to reconstruct the building. The property is located at 271-277B Lakeside Ave., Lake Williams Condominium Trust, being Map 80 Parcel 85 of the Assessors’ Maps.  The lot is located in Zoning Districts Business and Residence C.

An executive session is scheduled during the Zoning Board’s meeting scheduled for April 9th, 2013.  The executive session would be for the purpose of discussing strategy with respect to litigation, because an open meeting may have a detrimental effect on the litigating position of the Zoning Board of Appeals.
