Notice is hereby given that a public hearing will be held of November 29, 2011 (Tuesday) in the Marlborough City Hall, 140 Main St. 3rd floor-Memorial Hall, Marlborough, MA at 7:00 P.M. on the petition of the below named person as follows:
The applicant, 13 Lincoln Ct. LLC, proposes to reconstruct a two family dwelling within the same footprint of a prior structure which was damaged by fire. The applicant appeals the Building Inspector’s denial of his request for a building permit as referenced in the Building Inspector’s letter dated Sept. 16, 2011. The Applicant is appealing the Building Inspector’s decision on his asserted grounds that he is entitled to reconstruct the damaged structure as a matter of right under M.G.L. 40A, Section 6 as well as under the City of Marlborough’s Zoning Ordinance, Chapters 650-Section 12, 650-Section 17 and 650-Sections 40 thru 45. In the alternative, the Applicant requests the necessary variances and/or special permits [sic] to
reconstruct a two family dwelling at 13 Lincoln Ct., also known as Map 68, Parcel 169 of the Assessor’s Map.
