Notice is hereby given that a public hearing will be held on August 18, 2009 (Tuesday) in the Marlborough City Hall, 140 Main St.  Memorial Hall, 3rd Floor, Marlborough, MA  at 7:00 P.M. on the petition of the below named person seeking a variance in the application of the Zoning Ordinance of the City of Marlborough, as follows:   Continuation date of public hearing  Sept. 22, 2009 (Tuesday) at 8:15 P.M.  in Memorial Hall.

K5 Realty Trust, LLC (Michael Karl Kennedy, Mgr.)

The applicant is constructing a 29,600 sq. ft. of business park type space that includes combinations of office space with storage/warehouse type workspace.  The applicant is requesting variances from the following:

·       Chapter 200-49(D)(1) – reduce minimum pavement width on secondary driveway for two-way traffic flow from 24 ft. required to 20 ft. as available within existing 20 ft. wide right of way.
·       Chapter 200-47(E)(1)(a) – reduce minimum street frontage planting area from required 10 ft. to 0 ft available.
·       Chapter 200-47(F)(3) – reduce minimum 5  ft. side yard planting area from the required 5 ft. to 0 ft. available.
·       Chapter 200-47(D)(1) – reduce minimum centerline separation between major driveways from 150 ft. required to 20 ft. available.
·       Chapter 200-49(D)(5) – eliminate required granite curbing at the street right of way and maintain existing driveway as currently constructed.

The property is located in Zoning District Commercial Automotive, being Map 82, Parcel 138A as it contributes to other parcels, Map 82, Parcels 136A, 138A, 140, 141, 142, 144, 145, 146A, 146B and 273.  Also known as 247 Maple St. (Kennedy’s Commercial Automotive Complex)

Notice is hereby given that a public hearing will be held on Sept. 22, 2009 (Tuesday) in the Marlborough City Hall, 140 Main St.  3rd Floor, Memorial Hall, Marlborough, MA  at 7:00 P.M. on the petition of the below named person seeking a variance in the application of the Zoning Ordinance of the City of Marlborough, as follows:

Curtis and Carol Threatt

The applicant proposes to expand the existing paved parking in a rearward direction to include an additional area approximately 18' x 18' .   Zoning section 650-49(B)(2)(b) and 650-48(C)(5)(b)(i) and 650-48(C)(5)c  requires that the parking be set back at least 5' from the edge of the house and 5 ft. from the side property line.  In addition the “Maneuvering Function” of backing into the street cannot be met as required by section 650-49(C)(8)(a).   The property is located in Zoning District Residence RC, being Map 70, Parcel 170 of the Assessor’s Maps.  Also known as 48 Neil St.
