PLANNING BOARD MINUTES
April 23, 2007
7:00 PM


The Planning Board for the City of Marlborough met on Monday, April 23, 2007 in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Barbara Fenby, Chairperson, Steve Kerrigan, Clerk, Philip Hodge, Clyde Johnson, Robert Hanson and Sean Fay. Also present: City Engineer Tom Cullen.


MINUTES

Meeting Minutes April 9, 2007

On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:

To accept and file the meeting minutes of April 9, 2007.

CHAIR’S BUSINESS
        
APPROVAL NOT REQUIRED PLAN

219 Forest Street

Attorney David Gadbois presented the plans to the Planning Board. This site with be used for indoor/outdoor soccer fields.

On a motion by Mr. Hodge, seconded by Mr. Johnson it was duly voted:

To accept and refer the proposed plan to the City Engineer for his review and recommendation at the next meeting on Monday May 7, 2007.

Shawmut Ave (re-signing)

There were not enough original members to revote the signing. Once all members are present they will take a vote.



Stow Road

On a motion by Mr. Kerrigan, seconded by Mr. Johnson, it was duly voted:

To accept and endorse a plan of land believed to be Approval Not Required of Philip and Julie Purcell of 197 Stow Road, Marlborough, MA 01752.  Name of Engineer: Connorstone Consulting Civil Engineers, 276 West Main Street, Northborough, MA 01532.  Deed of property recorded in South Middlesex Registry of Deeds book 28031, page 239. Location and description of property:  located at 197 Stow Road property shown on Assessors map 46, parcel 32.

SUBDIVISION PROGRESS REPORTS

Update from City Engineer

Mr. Cullen stated that the attorney for Fiddlehead subdivision and the engineering department are in the process of working out the drainage issues. He also stated that the Davis Farm Subdivision water and sewer connections have been approved by the Department of Public Works.

Country Club Estates (Stow Road)

Proposed Bond Language

The proposed bond language was reviewed by the City Solicitor and he identified two issues with the language.

On a motion by Mr. Kerrigan and seconded by Mr. Hanson it was duly voted:

To accept and file Correspondence from City Solicitor Rider and forward the correspondence to the developers.

Crystal Ridge Estates (Danjou Drive)

Bond Reduction

The Developers have asked for a bond reduction. At this time the City Engineer and the developer are working on minor geometric issues and legal descriptions on the plans. The developers bond is currently a maintenance bond and will only be reduced to zero at the time of acceptance and recording of the subdivision.

On a motion by Mr. Kerrigan and seconded by Mr. Johnson it was duly voted:

To defer action until all issues have been resolved as well as acceptance and recording of the subdivision.

Elm Farm Valley Estates (Cleversy Drive)

The Developers have asked for a bond reduction. At this time the City Engineer and the developer are working on minor geometric issues and legal descriptions on the plans. The developers bond is currently a maintenance bond and will only be reduced to zero at the time of acceptance and recording of the subdivision.

On a motion by Mr. Kerrigan and seconded by Mr. Johnson it was duly voted:

To defer action until all issues have been resolved as well as acceptance and recording of the subdivision.

Orchard Estates III (Miele Road)

At the last Planning Board meeting the City Engineer stated that he and the developer would meet on site and go over the issues that still needed to be corrected. Mr. Cullen sent the meeting minutes to the Planning Board as well as the developer. Mr. Fossile, the developer, is in agreement of all the issues and will have something in writing back to the City Engineer on April 25, 2007. They are also in agreement to have the subdivision completed on or before June 4, 2007.

On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:

To accept and file all correspondence from the City Engineer.

On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:

To accept and file correspondence from Mr. Fossile.

Mr. Hanson signed the plans at the end of the meeting.

Devonshire at 495 (Boston Post Rd West)

On a motion by Mr. Kerrigan, seconded by Mr. Hanson it was duly voted:

To table any decision until all members who were present at the time of original acceptance are available to vote.

SCENIC ROADS

The Planning Board set a public hearing for May 21st at 7:30pm.

On a motion by Mr. Kerrigan, seconded by Mr. Hodge, it was duly voted:

To accept all of the items listed under communications and/or correspondence.

On a motion by Mr. Johnson, seconded by Mr. Kerrigan, it was duly voted:

To adjourn at 7:32 p.m.
