PLANNING BOARD MINUTES
April 9, 2007
7:00 PM



The Planning Board for the City of Marlborough met on Monday, April 9, 2007 in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Barbara Fenby, Chairperson, Steve Kerrigan, Clerk, Philip Hodge, Clyde Johnson, Edward Coveney and Sean Fay. Also present: City Engineer Tom Cullen.


MINUTES

Meeting Minutes March 26, 2007

On a motion by Mr. Hodge, seconded by Mr. Johnson it was duly voted:

To accept and file the meeting minutes of March 26, 2007 with the appropriate changes.

CHAIR’S BUSINESS
        
Mauro Farm

A letter from Martin Loiselle, Jr. of Capital Group informed the board that in the near future they will be submitting a conventional subdivision with 27 homes. They were concerned lot sizes of the Open Space Concept plan and they were not in favor of the common driveways.

On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:

To accept and file the correspondence and to forward the correspondence to the City Council.

APPROVAL NOT REQUIRED PLAN

Edinboro Street (re-signing)

Attorney David Gadbois submitted the approved ANR plan that was signed by Mr. Johnson on June 26, 2006. There have been no changes to the ANR plan and since 6 months has passed without being registered at the Middlesex Registry a new signature and date is required. Mr. Cullen reviewed the ANR and approved the resigning. Mr. Kerrigan is excluded from the vote since he was not a member of the Planning Board at that time.

On a motion by Mr. Johnson, seconded by Mr. Hodge it was duly voted:

To allow Mr. Johnson sign the ANR that was previously signed by him on June 26, 2006.

Shawmut Ave (re-signing)

There were not enough original members to revote the signing. Once all members are present they will take a vote.

Stow Road

Attorney David Gadbois brought in the ANR plans for the Limited Development Subdivision for 197 Stow Road. The ANR plans show the divided lots.

On a motion by Mr. Kerrigan, seconded by Mr. Coveney it was duly voted:

To refer the ANR plan to the Engineering Department for a full review.

PUBLIC HEARING

SUBDIVISION PROGRESS REPORTS

Update from City Engineer

Mr. Cullen stated there were no significant changes at this time.

Crystal Ridge Estates (Danjou Drive)

The Developer stated that all work has been completed as requested by the Engineering Department and is asking for a reduction of the bond along with the acceptance of the roadway.

On a motion by Mr. Johnson, seconded by Mr. Hodge it was duly voted:

To accept and file correspondence and refer the letter to the Engineering Department for a full review.

Elm Farm Valley Estates (Cleversy Drive)

The Developer stated that all items have been completed and would appreciate a reduction of the bond as well as the acceptance of the roadway.

On a motion by Mr. Johnson, seconded by Mr. Hodge it was duly voted:

To accept and file correspondence and to refer the letter to the Engineering Department for a full review.

Orchard Estates III (Miele Road)

The Developer is asking the Planning Board for a bond reduction. The Board and the Engineering Department have serious issues that need to be resolved before any reduction. Tom Cullen, the City Engineer, sent a letter to Mr. Fossile outlining all necessary work that needs to be completed on or before June 4, 2007 or he will recommend the Planning Board take the necessary steps to revoke the bond. Mr. Fossile, the Developer, stated to the board the completion of all the homes was nearly 3 years ago.  He also stated that all as-builts of the subdivision have been submitted to the Engineering Department and that there have been waivers granted by the Board for some of the issues. He also stated that the bond monies had expired and no longer available. The Board would like to see a completion schedule submitted to the Engineering Department before the next meeting on April 23, 2007.

On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:
To table all actions until the next meeting on April 23, 2007.

PENDING SUBDIVISION PLANS: Updates and Discussions

PRELIMINARY/ OPEN SPACE SUBDIVISION SUBMITTALS

DEFINITIVE SUBDIVISION SUBMISSIONS

Commonwealth Heights

The members, who were available to sign the plans, signed the plans at the end of the meeting. When Mr. Hanson returns, he will sign the plans.

Devonshire at 495 (Boston Post Rd West)

On a motion by Mr. Kerrigan, seconded by Mr. Hodge it was duly voted:

To table any decision until all members who were present at the time of original acceptance are available to vote.

SCENIC ROADS

Parmenter Road

Trask, Inc. is asking for the removal of three trees on the Citys’ right of way.

On a motion by Mr. Kerrigan, seconded by Mr. Hodge it was duly voted:

To Schedule a public hearing on May 7, 2007 at 7:30 pm and to forward the application to Chris White, the Citys’ Tree Warden.

On a motion by Mr. Johnson, seconded by Mr. Kerrigan, it was duly voted:

To accept all of the items listed under communications and/or correspondence.
