PLANNING BOARD MINUTES
December 4, 2006

The Planning Board for the City of Marlborough met on Monday, December 4, 2006 in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752. Members present: Edward Coveney, Robert Hanson, placeClyde L. Johnson, and Steve Kerrigan. Also present: City Engineer Tom Cullen.
ACTING CHAIRPERSON
On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:
To allow Mr. Coveney to act as chairperson.

Meeting Minutes November 20, 2006
On a motion by Mr. Johnson, seconded by Mr. Hanson it was duly voted:
To accept and file the minutes of the meeting on Monday, November 20, 2006.
CHAIR’S BUSINESS
Correspondence from Zoning Board of Appeals
Meeting minutes regarding St. Mary’s
The Zoning Board of Appeals sent to the Planning Board the meeting minutes of November 14, 2006 regarding their meeting for the revised plan of the proposed St. Mary’s of French Hill Condominiums.
On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:
To accept and file correspondence from the Zoning Board of Appeals.
Correspondence from Attorney Bergeron
St. Mary’s variance request
Correspondence from Attorney Bergeron regarding the St. Mary’s variance request was to notify the board of the procedures to follow for the meeting on December 18, 2006. Mrs. Lizotte explained to the board that after speaking with the City Solicitor, Donald Ryder, that this does not warrant a public hearing. However, the General Laws Chapter 40A sec. 11 does state that the interested parties need to be notified. The meeting notices were sent to the interested parties.
On a motion by Mr. Johnson, seconded by Mr. Hanson it was duly voted:
To accept and file correspondence.

PUBLIC HEARING
SUBDIVISION PROGRESS REPORTS
Update from City Engineer
Tom Cullen stated that there no modifications at this time as developers are preparing to winterize their subdivisions.
Eager Court
Passbook Performance Bond
The developer is asking the board to allow a passbook performance bond.
On a motion by Mr. Kerrigan, seconded by Mr. Hanson it was duly voted:
To accept and refer the correspondence to the City Comptroller and the City Solicitor for their approval.
Waters Edge
At the meeting on November 20, 2006 the developer asked to be put on the year maintenance period. Tom Cullen stated that Tom Temple has sent correspondence back to the developer that no work has been completed and that he will not recommend the subdivision for the maintenance period.

To accept all of the items listed under communications and/or correspondence.
