PLANNING BOARD MINUTES
June 12, 2006


The Planning Board for the City of CityMarlborough met on Monday, June 12, 2006 in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Chairperson Barbara L. Fenby, Acting Clerk Phil Hodge, Robert Hanson, Clyde L. Johnson, and Sean N. Fay.   Also present: Assistant City Engineer Tom Temple.


MINUTES

On a motion by Mr. Hodge, seconded by Mr. Fay it was duly voted:

To defer action on the meeting minutes until the next meeting on June 26, 2006.

 
CHAIR’S BUSINESS

Zoning Ordinance-Assisted Living Facilities

On a motion by Mr. Hodge, seconded by Mr. Johnson, it was duly voted:

To set public hearing date and time for the public hearing for the change to the zoning ordinance for assisted living facilities for July 24, 2006 at 8:00 PM.


APPROVAL NOT REQUIRED PLAN

77 Edinboro

Attorney Gadbois left new plan in his office, while he went to get the plan there was a motion to table any action.

On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To table this matter until Attorney Gadbois came back with the submittal.


On a motion by Mr. Hodge, seconded by Mr. Johnson, it was duly voted:

To reopen a previous discussion that was tabled.

On a motion by Mr. Johnson, seconded by Mr. Fay, it was duly voted:

To accept and refer the proposed plan to the Acting City Engineer for his review and recommendation at the next meeting on Monday, June 26, 2006.

On a motion by Mr. Hodge, seconded by Mr. Johnson, it was duly voted:

To accept and refer the proposed plan to the Acting City Engineer for his review and recommendation at the next meeting on Monday, June 26, 2006.


PUBLIC HEARING


SUBDIVISION PROGRESS REPORTS

Update from City Engineer

Tom Temple, the Assistant City Engineer informed the board that 13 subdivisions are in the final stages of completion. He has resent letters to the subdivision contractors to let them know he is actively looking for completion schedules and well as tentative start dates.

Forest Trail

Bond Reduction

On a motion by Mr. Johnson, seconded by Mr. Hodge it was duly voted:

At the request from the developer and recommendation from Acting City Engineer Thomas Temple for a bond reduction at the Forest Trail subdivision, and to reduce the bond from $320,000.00 to $260,000.00.

Bond Reduction Parcel “B”

On a motion by Mr. Johnson, seconded by Mr. Hodge it was duly voted:

To send correspondence to the City Conversation Officer, Pricilla Ryder and the Citys Tree Warden, Chris White for approval of the trees before the next meeting to make a recommendation on the parcel B bond.

Eager Court

On a motion by Mr. Johnson, seconded by Mr. Hodge it was duly voted:

To accept and refer the request by the developer to the Acting City Engineer Thomas Temple for his review and recommendation at the next meeting on Monday, June 26, 2006.


Indian Hill Park Definitive Subdivision

On a motion by Mr. Hodge, seconded by Mr. Fay it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple recommending an extension of the subdivision and to approve a one month extension from the date of this meeting with the understanding that within this one month extension the board will see a newly revised completion schedule for all outstanding work.


PENDING SUBDIVISION PLANS: Updates and Discussions

White Oak Estates

Attorney Gadbois submitted a letter to the Planning Board and to the City Solicitor, Donald Rider.
Attorney Gadbois is advising the Planning Board that his clients will not act on the prescriptive approved subdivision until such time of ownership of the land is determined. Since the late submittal of the letter the Planning Board will refer the letter the City Solicitor for his comments.

On a motion by Mr. Fey and seconded by Mr. Johnson it was duly voted:

To accept and refer the correspondence to City Solicitor Donald Rider for his comments.  


PRELIMINARY/ OPEN SPACE SUBDIVISION SUBMISSIONS

Old Orchard Heights

Tom DiPersio of Thomas Land Surveyors made a presentation of the land located on addressStreetHosmer Street. According to the intent of the new Limited Development Subdivision ordinance to be able to do 2 ½ times the minimum lot area of the zoning district. However, the plans that were shown to the planning board were not showing the 2 ½ times of the minimum lot area. Mr. DiPersio was asked to revise the submittal to show the correct plan.

Stow Road

After the first submittal of the Limited Development Subdivision Tim Peris from Connorstone had met with Tim Collins and Tom Temple of the City Engineers office regarding the plans. However due to a misunderstanding in the City Engineers on the ordinance itself with the 2 ½ times allowed for minimum lot area they did not fully understand the ordinance.  Hence, the plans did not show the correct number of lots for the subdivision to be considered a Limited Development Subdivision.

Tom Temple and Phil Hodge agreed at the meeting that there will be a forthcoming meeting between Mr. Hodge and the City Engineers office regarding Limited Development Subdivisions.
