PLANNING BOARD MINUTES
November 21, 2005


The Planning Board for the City of Marlborough met on Monday, November 7, 2005 in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Chairperson Barbara L. Fenby, Acting Clerk Philip J. Hodge, Robert Hanson, and Clyde L. Johnson.   Also present: City Engineer James Arsenault.

MINUTES

On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To accept the minutes of the meeting of Monday, November 7, 2005.

CHAIR’S BUSINESS

Scenic Road 410 Stow Road

On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To accept correspondence of a withdrawal of a scenic road permit from Mr. and Mrs. Kane.


APPROVAL NOT REQUIRED PLAN

Cedar Hill Street

On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To refer this plan over to the City Engineer for his review. His comments will be made at the next meeting on December 5, 2005.

PLANNING BOARD
PUBLIC HEARING NOTICE

The Planning Board of the City of Marlborough held a public hearing on Monday, November 21, 2005 at 8:15 p.m.  on a Definitive Subdivision Plan “The Residences of Oak Crest”.  Members present: Chairperson Barbara L. Fenby, Phil Hodge, Robert Hanson and Clyde L. Johnson.  Also present: City Engineer James Arsenault.

Chairperson Fenby introduced the staff and members of the Board and explained the public hearing process.  Acting Clerk Phil Hodge read a copy of the advertisement into the record.

Notice is hereby given that the Planning Board of the City of Marlborough will hold a public hearing on Monday, November 21, 2005 at 8:15 P.M., at Memorial Hall, City Hall, 140 Main Street, Marlborough, MA on the following Definitive Subdivision Plan “Residence at Oak Crest” subdivision which proposal is herewith published in compliance with the requirements of the M.G.L. 41, §81T and is hereby set forth as follows:


NAME OF SUBDIVIDER:             Total Concept Builders LLC
                                        32 Frye Road
                                        Bolton, MA 01740


NAME OF ENGINEER:               FORESITE Engineering Assoc, Inc.
                                        16 Gleasondale Road Suite 1-1
                                        Stow, MA 01775


LOCATION OF PROPERTY:           133,589 s.f.  lot off Daniels Road


Scott Hayes of Foresite Engineering Associates, Inc., on behalf of his client, Laurie A. Sordillo and Mary E. Saristo, made a brief presentation of the proposed development.


The plan calls for a request of the following waivers:

·       To allow the proposed vertical curve be less then 100 feet as required.

Marlborough, MA

His position was that with Daniels Road being built he was not in favor due to the loss of Black Walnut trees he had planted on his property many years ago. He feels that this new subdivision will be built on a paper street. He also had question on fire access and if the fire department would be able to properly turn in the cul-de-sac.  

There being no further discussion, the hearing was closed at 8:30 p.m.

SUBDIVISION PROGRESS REPORTS

Update from City Engineer

Mr. Arsenault let the board members know that there has been road paving in two subdivisions, one being Forest Trail and the other being Fiddlehead.


Indian Hill

On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To accept and file correspondence from Janice Hannert of FRE Building CO., on a bond release for this subdivision; referred to the City Engineer for acceptance.

Forest Grove


On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To accept and file the correspondence from Janice Hannert of FRE Building CO., on a bond release for this subdivision and referred to the City Engineer for acceptance.


Forest Trail

Mrs. Lizotte did inform the board that there were concerns from Priscilla Ryder, Conservation Commissioner for the City of Marlborough, on releasing any bond monies. A document is forthcoming at the next meeting on December 5, 2005.

On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To accept and file correspondence from Chris Mutti on a bond reduction of “Parcel B” of the trees/plants and this was referred to the City Engineer for his consideration.

Also several of the residents of the Forest Trail spoke asked to speak at this meeting:

Mr. Magner asked if it was possible to hold the bond in tact until the trees on Mosher Lane have matured.

Mrs. Kyle Magner

Mrs. Magner asked the board if Mr. Mutti was to supply each house lot with two trees.

Mrs. Dorothy Butler
85 Mosher Lane

Mrs. Butler had a question on the second seal coat on the driveways. The Board determined that was a contract issue with Mr. Mutti and the board had no jurisdiction.


PENDING SUBDIVISION PLANS: Updates and Discussions
Commonwealth Heights

On a motion by Mr. Hanson, seconded by Mr. Johnson, it was duly voted:

To accept and file the correspondence from Pricilla Ryder, Conservation Commissioner for the City of Marlborough, which states that the Board of Health will be hiring an independent Licensed Site Professional to review the Environmental Assessment and Soil Management for Both Commonwealth Heights and The Beacon Parcel.


DEFINITIVE SUBDIVISION SUBMISSIONS


SIGNS

CVS

On November 7, 2005 the board was asked by CVS if they would consider letting them change their sign location on their parcel. With having seen the plan the board agreed they would take a look at the site.  The members have all agreed on the site that would be the best.  Mr. Robert Connors, from Karnack Reality stated he is on the Site Plan Agenda for December 6, 2005 to discuss moving the sign. CVS will then come back to the Planning Board on December 19, 2005 with a formal application on for the variance to move their sign.


HANNAFORDS

Steve Reid, the City of Marlboroughs Building Commissioner, sent a letter to the board advising the board that Hannafords Supermarket will be looking to submit a sign permit.  Hannafords is now occupying the space that Victory Super Market has once occupied located at 197 Boston Post Road West and adopting their sign ordinance from 1995 for flatwall signs. At that time the board clearly stated since Victory had exceeded the sign usage they would not be allowed to occupy any space on the freestanding sign.

At this time the Board feels that if they would like to pursue an informal discussion to discuss the changes and why they feel it would be necessary for Hannafords to have any signage on the freestanding sign then they are more then welcome to come before the board.
