PLANNING BOARD MINUTES
November 29, 2004

The Planning Board for the City of Marlborough met on Monday, November 29, 2004, in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Chairperson Barbara L. Fenby, Clerk Colleen M. Hughes, Philip J. Hodge, Edward F. Coveney, Robert Hanson and Clyde L. Johnson.  Also present: City Engineer James Arsenault.

MINUTES

On a motion by Ms. Hughes, seconded by Mr. Hanson, it was duly voted:

To accept and file the minutes of the November 15, 2004 meeting.

CHAIR’S BUSINESS

Jericho Hill Trees

On a motion by Ms. Hughes, seconded by Mr. Johnson, it was duly voted:

To accept and file the correspondence from DPW Commissioner LaFreniere and to send correspondence expressing the Board’s disappointment that it appears the City is requiring a standard of homeowners and developers that is not being conformed to by the City.   

Update on Limited Development Subdivisions

Mrs. Wilderman explained that the Limited Development Subdivision did not get reported out of committee at the last City Council meeting as expected.  Councilor Schafer, who was in the Board meeting on another matter, explained that they were waiting for confirmation from the City Solicitor regarding whether the minor wording change for any proposed common driveways would require new public hearings.  In the Solicitor’s opinion that was not the case but unfortunately the message missed the last meeting deadline.

It is expected that Mr. Yurkus, as the Committee Chair, will report the document out of committee this evening and ask for a suspension of the rules to vote on the document tonight.

On a motion by Ms. Hughes, seconded by Mr. Hodge, it was duly voted:

To accept and file the correspondence from the Council regarding the minor change to the amendment.

APPROVAL NOT REQUIRED PLANS

Attorney Gadbois for Glenborough Fund

On a motion by Mr. Hodge, seconded by Mr. Johnson, it was duly voted:

To accept and refer the plan to the City Engineer for his review and recommendation at the next meeting on Monday, December 6, 2004.

SUBDIVISION PROGRESS REPORTS

Update from City Engineer

Mr. Arsenault advised the Board that he is working closely with Assistant City Engineer Temple to clean up their outstanding subdivision files and close out as many as can be accomplished.

Forest Trail Bond

On a motion by Ms. Hughes, seconded by Mr. Hodge, it was duly voted:

To accept and file the correspondence from City Solicitor Agoritsas approving the form of the subdivision approval denial and the documents revoking the bond.

On a motion by Ms. Hughes, seconded by Mr. Hodge, it was duly voted:

To authorize the Chairperson to sign the “Vote of Revocation” revoking the subdivision approval and the outstand lot releases.

On a motion by Mr. Hodge, seconded by Mr. Coveney, it was duly voted:

To authorize the Chairperson to sign and cause to be delivered a certified notice of default to the Hudson Savings Bank.

On a motion by Mr. Coveney, seconded by Mr. Hodge, it was duly voted:

To direct the City of Marlborough Treasurer Thomas Abel, to cause a site draft in the amount of $320,000.00 plus accrued interest to be drawn under the performance bond in relation to the default of the Forest Trail Estates Subdivision.

Crystal Ridge Estates

On a motion by Mr. Hodge, seconded by Mr. Johnson, it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple and to continue the issue until the next meeting on Monday, December 6, 2004, after the developer has had a chance to meet with City Engineer.

Elm Farm Valley Estates

On a motion by Ms. Hughes, seconded by Mr. Hodge, it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple and to continue the issue until the next meeting on Monday, December 6, 2004, after the developer has had a chance to meet with City Engineer.

Orchard Estates III

On a motion by Mr. Johnson, seconded by Mr. Coveney, it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple and to continue the issue until the next meeting on Monday, December 6, 2004, after the developer has had a chance to meet with City Engineer.

PENDING SUBDIVISION PLANS:  Updates and Discussions

Old Orchard Heights

This subdivision has been extended until December 6, 2004.

Eager Court

The developer still has not provided the revised plans.

Berlin Farms

The board is still waiting for a draft of the special permit from the developer.

PRELIMINARY/OPEN SPACE SUBMISSIONS

Birchwood Development

Attorney Gadbois gave the Board a brief overview of a proposed preliminary plan.  Due to the holiday schedule the Planning Board will hold the public hearing during the new year.

Communication and Correspondence

On a motion by Ms. Hughes, seconded by Mr. Coveney, it was duly voted:

To accept and file all documents under communication and/or correspondence.

On a motion by Mr. Johnson, seconded by Mr. Coveney, it was duly voted:

To adjourn at 8:00 p.m.
