PLANNING BOARD MINUTES
October 18, 2004

The Planning Board for the City of Marlborough met on Monday, October 18, 2004, in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Chairperson Barbara L. Fenby, Acting Clerk Philip J. Hodge, Edward F. Coveney, Robert Hanson and Clyde L. Johnson.  Also present: City Engineer James Arsenault.

MINUTES

On a motion by Mr. Johnson, seconded by Mr. Hanson, it was duly voted:

To table consideration of this topic until the next meeting when the members will have had time to review the minutes.

CHAIR’S BUSINESS

Jericho Hill Trees

Commissioner LaFreniere has been on vacation and will respond upon his return.

Update on Limited Development Subdivisions

The Urban Affairs Committee will not be meeting on this topic until Tuesday, October 19, 2004.  Both Mr. Hodge and Mrs. Wilderman will be available at the meeting to answer any questions the committee may have.

Berlin Farms Special Permit Application

No discussion took place regarding this proposed application due to a quorum issue.

PUBLIC HEARING

7:45 p.m. Robin Hill at Donahue Drive

Tree Warden Chris White advised the Board that they have been watching this particular tree for some time and it is now showing serious signs of decline.  (Pictures of the tree were distributed).  

No one spoke either in favor or in opposition to the trees removal.

On a motion by Mr. Johnson, seconded by Mr. Coveney, it was duly voted:

To authorize the removal of the tree.

SUBDIVISION PROGRESS REPORTS

Update from City Engineer

Mr. Arsenault advised that there was no update document available for this meeting.

Water’s Edge Subdivision

Mrs. Wilderman informed the Board that the developer had contacted the office on Friday, October 15 to advise that he had not had a chance to complete the work discussed with Mr. Temple and that he hoped to have it completed by the next meeting.

Chairperson Fenby advised that the trail signs are down again and the trail is in bad shape.  Mrs. Wilderman will advise Conservation Officer Ryder.  It would appear that the same neighbor may be responsible for the damage as he is unhappy about having a trail behind his home.

Forest Trail bond

The Board has received a request to extend the approval for this subdivision as the approval ran out in September.  

Mrs. Wilderman advised the Board that she spoke with the developers attorney regarding the required bond to guarantee the survival of the trees placed in the open space.  As the deforestation of that space was not contemplated by the original bond figure to secure the subdivision, Mr. Mutti is still responsible for posting a $36,200.00 for the tree replacement.

On a motion by Mr. Hodge, seconded by Mr. Hanson, it was duly voted:

To extend approval of this subdivision until the next meeting on Monday, November 15 2004 and to correspond with the developer’s attorney regarding the bond monies.

Indian Hill Roadway

On a motion by Mr. Hodge, seconded by Mr. Johnson, it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple and to recommend that the bond securing the subdivision remain at $321,000.00 until such time as the items on the punchlist be completed.

Forest Grove

On a motion by Mr. Johnson, seconded by Mr. Hanson, it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple and to recommend that the bond securing the subdivision should remain at $194,000.00 until such time as the submitted punchlist items are completed.

PENDING SUBDIVISION PLANS; Updates and Discussions

Old Orchard Heights

Mr. Poole and Mr. Temple are scheduled to meet to discuss the final amendments to this plan within the next two days.

On a motion by Mr. Hanson, seconded by Mr. Hodge, it was duly voted:

To accept and file the correspondence from Stephen Poole and to approve an extension of the subdivision approval until the next meeting on Monday, November 15, 2004.

Eager Court

The revised plans have still not be submitted by Mr. DiPersio.

SIGNS

Target on Donald Lynch Boulevard

Acting Clerk Hodge read into the record a memo from Site Plan Committee Chair Alfred Lima recommending that Target address the landscaping screening with the Site Plan Committee rather than allow a variance to the sign ordinance.

On a motion by Mr. Johnson, seconded by Mr. Hodge, it was duly voted:

To accept and file the correspondence from Site Plan Review Committee Chair Alfred Lima and to deny the application for a variance from the sign ordinance.

Staples on Boston Post Road East

A review of the submittal for the original sign application and variance showed that the sign did not require a variance due to the size of the store and the setback from the roadway.  The original sign permit application will be issued by the Inspectional Services Office on Tuesday, October 19, 2004.

COMMUNICATION/CORRESPONDENCE

On a motion by Mr. Hodge, seconded by Mr. Hanson, it was duly voted:

To accept and file all items listed under communication and/or correspondence.

On a motion by Mr. Johnson, seconded by Mr. Coveney, it was duly voted:

To adjourn at 8:15 p.m.
