The Planning Board for the City of Marlborough met on Monday, April 7, 2003, in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752. Members present: Chairperson Barbara L. Fenby, Clerk Colleen M. Hughes, Philip J. Hodge, Edward F. Coveney, Raymond R. Peters, Robert Hanson and Clyde L. Johnson. Also present: City Engineer Patrick M. Clancy.

PUBLIC HEARINGS
8:00 P.M. Preliminary Subdivision O’Leary’s Landing
The Planning Board of the City of Marlborough held a public hearing on Monday, April 7, 2003, at 8:00 p.m. in Memorial Hall, 3rd Floor, City Hall, 140 Main Street, Marlborough, on the Preliminary Plan of a Subdivision entitled “O’Leary’s Landing”. Members present: Chairperson Barbara L. Fenby, Clerk Colleen M. Hughes, Philip J. Hodge, Edward F. Coveney, Raymond R. Peters, Robert Hanson and Clyde L. Johnson. Also present: City Engineer Patrick M. Clancy.
Chairperson Fenby introduced the staff and Board members and explained the process to those present at the meeting. Clerk Hughes read a copy of the proposal advertisement.

A plan of the proposed subdivision is on file in the City Clerk's Office, the Planning Board Office, and the City Engineer's Office and may be seen prior to the public hearing.
Timothy D. Paris, P.E. of Connorstone Engineering, gave a brief presentation of the projected development.
The project is approximately 3.5 acres of land on the north side of Berlin Road and will encompass only three house lots. One of the lots will have their frontage on Berlin Road. Drainage will be directed to the back of the lot to a proposed detention basin. Sewer and water services will be continued onto the property from Berlin Road.

Ms. Kerwin is concerned with the location of the entrance to the subdivision as it is a “horrible spot” in the roadway. It appears to be right at a curve in the roadway through which drivers sail through. She asked if the developer could consider moving the roadway more towards her property.
Mr. Paris indicated that the currently proposed location seemed to allow sufficient sight lines. It is also the location of the driveway currently. Chairperson Fenby allowed that they would look at that suggestion during the review period.
Louis W. Desisto
49 Ethier Circle
Mr. Desisto wished to confirm that the zoning for this property is still single family.
City Engineer Clancy advised the proponent of the issue sewer connections to the westerly treatment plant and to contact the Engineering Department for the new regulations. He also advised that one of the lots looks at though it may have some difficulty meeting the lot shape requirement.
Ralph Belmore
230 West Main Street
Mr. Belmore wanted to know how where lot 1’s driveway would be. Mr. Paris explained that the frontage for the lot was gained from Berlin Road but in all probability the driveway would enter from the new cul-de-sac.
Chairperson Fenby advised the attendees that the plan would now go to the Engineering Department for review and work. She also advised that this is a preliminary plan only so the neighbors would be advised when the definitive plan was submitted for another public hearing.
There being no further discussion, the hearing was closed at 8:15 p.m.
SUBDIVISION PROGRESS REPORTS
Update by City Engineer
Mr. Clancy advised the Board that each developer has been sent a letter asking for their construction schedules. To date none have been returned.
Devonshire at 495 covenant and signature
This project is not ready for signature at this time.
Bridan Circle: request from developer of rescission of approval
At its meeting on Monday, April 07, 2003, the Planning Board took the following action:
On a motion by Mr. Hodge, seconded by Mr. Peters, it was duly voted:
To revoke the approval of the subdivision entitled “Definitive Subdivision Plans, Open Space Development, Marlborough, MA: Karopulios Drive”, dated February 18, 1999 and revised though August 2, 1999, as the owner has received permission to construct housing under a comprehensive permit (Chapter 40B of the Massachusetts General Laws). Name of Original Subdivider Karen Heffernan. Engineer: Devellis Associates, Inc., 2310 Washington Street, Suite 320, Newton, MA 02162. Covenant recorded in the Middlesex South Registry of Deeds in Book 31196, page 68, on March 8, 2000.
Hudson Street Crossing
On a motion by Mr. Hodge, seconded by Mr. Johnson, it was duly voted:
To refer to the City Engineer the request by the developer for the final acceptance of the subdivision and the streets for his recommendation at the next meeting on Monday, April 28, 2003.
Shaughnessey Estates
On a motion by Mr. Johnson, seconded by Mr. Hanson, it was duly voted:
To accept and file the correspondence from Building Commissioner Reid to FCM builders regarding the landscaping issues at this subdivision.
Forest Trail
On a motion by Mr. Peters, seconded by Mr. Hanson, it was duly voted:
To accept and file the correspondence from Conservation Officer Ryder regarding the clearing of one of the open space parcels, to ask that the developer attend the next Planning Board meeting on Monday, April 28, 2003 to discuss his planting plan, and to ask that Mrs. Wilderman and Mr. Clancy investigate the ability to issues fines.
PENDING SUBDIVISION PLANS: Updates and Discussions
Definitive Subdivision Berlin Road
The correct plan was submitted for signature.
Definitive Shorter Street
A brief discussion was held regarding the requirement for a cul-de-sac for emergency vehicle purposes. There were e-mails from both Chief Kyle (FD) and Chief Leonard (PD) in which they advised that no cul-de-sacs were needed for their purposes. The driveway, completed to a standard that would support the weight of a fire or rescue vehicle, would be sufficient for a turn around. However the Board would like the developer to look at designing the roadway at a 24-foot width instead of the 18-foot proposed.
Acre Bridge Estates
This subdivision still does not have a complete submittal.
