Planning Board Minutes 02/10/2003
The Planning Board for the City of Marlborough met on Monday, January 27, 2003, in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Chairperson Barbara L. Fenby, Clerk Colleen M. Hughes, Edward F. Coveney, Robert Hanson and Raymond R. Peters.  Also present: City Engineer Patrick M. Clancy.

MINUTES

On a motion by Ms. Hughes, seconded by Mr. Peters, it was duly voted:

To accept and file the minutes of the meeting of December 16, 2002.

On a motion by Mr. Peters, seconded by Mr. Hanson, it was duly voted:

To accept and file the minutes of the meeting of January 27, 2003.

CHAIR’S BUSINESS

Update by Director of Planning Lima

Mr. Lima was unavailable for this meeting.

Signature of Acceptance Plans

On a motion by Ms. Hughes, seconded by Mr. Peters, it was duly voted:

To sign all of the street acceptance plans presented by the City Engineer.

Attorney Bergeron petition for joint public hearing

Attorney Bergeron, on behalf of his client Jon Delli Priscolli, made an impassioned speech to the Board entreating them to agree to a joint public hearing on the newest iteration of the amendments to the zoning ordinance for the Fitchburg Street property.

The Board agreed to the joint public hearing but cautioned Attorney Bergeron that in an effort to insure the impartiality of the process they may not be able to reach a decision on the same evening.  If there are people who are opposed to the change at the public hearing, it would not be appropriate to appear to be hurrying the process on behalf of the developer.  

Further, Mr. Bergeron will make a presentation at the next meeting on Monday, February 24, 2003 to explain the changes to the proposal.  

Mrs. Wilderman will also have comments from Commissioner Reid and Planning Director Lima available to the members for the project as well.

APPROVAL NOT REQUIRED PLANS

Barnes Property Stow Road

On a motion by Mr. Hanson, seconded by Mr. Peters, it was duly voted:

To accept and endorse the plan believed to be Approval Not Required of Steven and Laurie Barnes, 689 Stow Road, Marlborough, MA 01752.  Engineer: Central Mass. Engineering and Survey Company, Inc., 45 River Street, Marlborough, MA 01752.  Deed of property recorded in Middlesex Registry of Deeds book 26663, page 265.  Location and description of property: 64,300 square feet of land on the east side of Stow Road to be divided into one conforming house lot and one 20,000 square foot parcel, not to be considered a building lot.

SUBDIVISION PROGRESS REPORTS

Update by City Engineer

City Engineer Clancy distributed the latest subdivision update report.  He advised that his office plans on closing several of the outstanding open subdivision and that correspondence will be sent out shortly.

Hudson Street Crossing request for acceptance

On a motion by Ms. Hughes, seconded by Mr. Peters, it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple regarding the bond and maintenance period for this subdivision and to recommend that the bond securing the subdivision may be reduced to a Maintenance bond of $46, 000.00.  It is also noted that the one-year maintenance period started on April 8, 2002.

Fahey Street request for extension

On a motion by Mr. Coveney, seconded by Mr. Peters, it was duly voted:

To accept and file the correspondence from Assistant City Engineer Thomas P. Temple regarding an extension of the subdivision and to approve a six month extension from the date of this meeting and to order that a completion schedule that includes all of the outstanding work items included in a fax from the City Engineer’s office to W.R.E. Company on July 23, 2002.

PENDING SUBDIVISION PLANS: Updates and Discussions

Definitive Plan Berlin Road

On a motion by Mr. Peters, seconded by Mr. Coveney, it was duly voted:

To accept the wording of the conservation restriction for the back parcel of land.

On a motion by Ms. Hughes, seconded by Mr. Coveney, it was duly voted:

To grant a waiver from the Subdivision Rules and Regulations section III.11 (f) requiring compliance with all applicable zoning requirements as to the requirement for sufficient frontage.  The developer is advised that he must still appear before the Zoning Board of Appeals for relief from the frontage requirements in order to establish a buildable lot.

On a motion by Ms. Hughes, seconded by Mr. Coveney, it was duly voted:

To approve the Definitive Plan of a subdivision known as “Definitive Subdivision Plan” Plan of land in Marlborough, MA.  The developer has agreed to have a conservation restriction placed on the rear of the property to insure against further subdivision and to protect the city’s watershed.

Mrs. Wilderman advised the Board that due to illness, Mr. Blum would not be available at this meeting.  

PRELIMINARY/OPEN SPACE SUBMISSIONS

O’Leary’s Landing

On a motion by Ms. Hughes, seconded by Mr. Coveney, it was duly voted:

To accept and file Mrs. Wilderman’s letter to the developer’s engineering firm and to withhold formal acceptance of the plan until such time as all of the appropriate paperwork has been submitted.

SIGNS

As the Director of Planning has advised the Board that he is working on the entrance way to the city zoning requirements, a copy of the original variance that allowed the existing “Welcome to Marlborough” was distributed to the members for their information.

COMMUNICATIONS/CORRESPONDENCE

On a motion by Ms. Hughes, seconded by Mr. Coveney, it was duly voted:

To accept and file all items listed under communications and/or correspondence.

On a motion by Mr. Peters, seconded by Mr. Coveney, it was duly voted:

To adjourn at 8:15 P.M.
