Discussion
§ Orchard Estates III; Letter from Paul Balutis dated Dec. 13th 2002 Re: Conservation land that abuts Balcom, Stow and Miele Rd. The Commission reviewed this letter and discussed the new trails and decided to send a letter to the Planning Board indicating that if the trail off Balcom Rd. is not constructed that perhaps Mr. Fossile should be required to construct the new parking lot to be installed at the Mellow Family Meadow Conservation Land.
§ DEP 212 – 861 (Boston Post Rd.) - Minor changes to plan Exxon mobile (was Equiva) - The Commission reviewed a letter regarding some minor changes to the approved plan, which reduces the building and pavement layout. However, these changes do not impact work within the 100 ft. buffer zone. The Commission voted 5 to 2 to accept the changes described as minor changes; therefore, no further review by the Commission is required.
Public Hearings
Request for Determination of Applicability
Lot A Beach St. - Guaranteed Builders, Inc.
Diane Pantermoller of Andrews Survey and Engineering was present. She requested a determination for the construction of a single-family house in the wetlands buffer zone. The closest point the work will be performed to the wetland is 64 feet. The house will be 62 feet away for the wetland. Ms. Ryder indicated she had not checked the site or the wetland boundaries. The Commission determined that this area has lots of peat and the determination of the wetland line is important since it may be closer than shown on the plan. The Commission asked Mr. Ryder to take a look at the site and check the soils prior to the next meeting to confirm where the wetland boundary is located.
Chairman Clancy indicated that the wetland is an Inland Restricted Wetland and it may have additional restrictions. The Commission reviewed the plan and determines that all excavated materials must be removed from the site and dewatering might be required.
The Commission continued the hearing to January 16th with the applicant’s permission so the wetland could be checked.
Notice of Intent (Continuation of Public Hearing)
Donald Lynch Blvd. (Map 50 Parcel 8) – New England Development
John Twohig of Goulston & Storrs and Arthur Towne of Dewberry, Goodkind, Inc. and Brenda Bhatti of ENSR were present. John Twohig explained that there were several additional items present based on the previous meeting regarding the berm, the outlet pipe, the fencing, the swale, the emergency outlet and the planting plan. Arthur Towne reviewed these items, which were shown on the plan dated revised Jan. 2, 2003.
1. Berm—the structural integrity of the berm was reviewed. It now includes a new detail for installing an impermeable barrier along the inside of the berm.
2. The existing pipe – the existing pipe will need to be inspected and new rip-rap of 1-2 inch stones will be placed at the flared end. The pipe will need to be inspected and may need to be cleaned and/or relined. The Commission determined that the integrity of the berm needs to be maintained and if it is determined the pipe needs to be replaced completely and the berm excavated, a new plan with a detail drawing of this pipe replacement will need to be provided to the Commission and the City Engineer for review and approval prior to construction.
3. Fencing – The fence will be located around the detention basin and will have small spaces underneath to allow for the movement of wildlife. The Commission discussed the location of the fence and determined that the fence should be on the inside of the berm on the riverside of the detention basin to minimize clearing, and can be located anywhere on the building side of the detention basin.
4. The swale along Donald Lynch Blvd. has been regraded on the plan to allow the drainage to drain in the opposite direction towards the driveway entrance rather than the river. The area will all be grassed which will aid in water quality improvement of stormwater runoff.
5. The emergency spillway was shifted to require less tree clearing along the existing berm. This area should be field verified prior to clearing to assure that it is properly located to protect as many trees as possible.
6. The detention basin berm has been redesigned to allow a 10 ft. wide area on the building side of the detention basin for access to maintain the detention basin.
7. The snow storage area has been designated on the plans at the sourthern corner across from the entrance. This is located away from both the detention basin and the wetland area. There will be no snow dumping within the wetland area or the detention basin.
Brenda Bhatti presented the revised planting plant for the detention basin dated Dec. 31, 2002. The exact location of the plantings will be decided in the fields to fill in the gaps along the berm to provide a good screen between the river and the restaurant. The size of the trees will be 1½ in. to 2 in. caliper trees and the shrubs and herbaceous layer will be one-gallon pots size. Ash trees are shown on the list of plants to be used. The Commission requested that this be substituted since Ash trees are susceptible to a blighting.
A new phasing plan is shown and described on Sheet C-4. This was reviewed and discussed by the Commission. The Commission requested that silt socks be added to the catch basin on Donald Lynch Boulevard as necessary to protect that drainage system.
After some discussion the Commission closed the public hearing and will review a draft Order of Conditions at the January 16th meeting.
Certificate of Compliances
§ DEP 212–838 340 Maple Street. – The Commission reviews the request for a Certificate of Compliance. Ms. Ryder indicated everything was in order and the Commission voted 5 to 0 to issue a Certificate of Compliance with ongoing conditions for stormwater maintenance.
§ DEP 212-685 Waters Edge Subdivision – Ms. Ryder indicated that the Engineering Department still had some problems with the level of the detention basin and the sloughing of one of the slopes and recommended not to issue a Certificate of Compliance. The Commission determined that no certificate would be issued until the Engineering Department was satisfied with the detention basin and the stability of the site.

§ MACC annual meeting – this year’s meeting will be held on March 1st the Commission Members were asked to sign up.
§ Allan Chlapowski, Eagle Scout, will be holding his court of honor on January 25th at 6:30 PM. He has invited the Commission Members to attend.
