Discussion
§ Draft Order of Conditions DEP 212-914 770 Boston Post Rd. – Amerada Hess Corp. The Commission reviewed a draft Order and made some changes regarding prevention of contamination and protection of the infiltration system. The Commission voted 7-0 to approve the project and issue the Order of Conditions as drafted and amended.

This hearing was continued with the applicant’s consent to the May 15th meeting to allow time for Pat Clancy, City Engineer, to provide comments.

114 Kelber Dr. (Lot 5) – Mark Evangelous
Brian Butler of Oxbow Associates represented the applicant. He noted that at the last meeting the Commission had asked that they make the house smaller to fit the site better. The owner and the site contractor, Mike O’Malley, have said that five feet is enough room to construct the house without impacting the 20-foot buffer zone, therefore, the house plan is the same. The Commission noted that no deck could be built on the wetland side of the house and conditions will be added to ensure there is no encroachment on the wetland area. There was some discussion about the swale and construction practices. The Commission closed the hearing and will review a draft Order of Conditions at the next meeting on May 15, 2003.

Crane Meadow Rd. (Fairfield Green at Marlborough) - FF Development LP
John Shipe of Rizzo Associates, Jay Johnson and Andrew Montelli of Fairfield and Debbie Horwitze of Gouldston & Storrs were present.
John Shipe provided a new erosion control plan, which was sent to the Commission members. The two new plans are sheets 7A and 7B. These new plans provide a sequencing and detailed erosion control plan. The Commission discussed in detail the construction sequencing plan, as this is a very large site, and will be a problem if the site is not phased properly. The Commission discussed construction monitoring, erosion controls, groundwater control with seepage collars, temporary basins during construction and procedures for construction phasing progressions. The Commission noted that this site drains into Southborough and into the Sudbury Reservoir, therefore water quality issues are extremely important for this site. The Commission is still waiting for comments back
from the City Engineer and wanted more information about the sewer diversion project. With the applicants consent the hearing was continued to June 5, 2003.

Certificates of Compliance
§ DEP 212-768 51 Lakeshore Dr. - The Commission voted 6-0 to issue a Full Certificate of Compliance for this project.
§ DEP 212-789 755 Hemenway St. - The Commission voted 6-0 to issue a Full Certificate of Compliance for this project.
Extension Permits
§ DEP 212-802 Fitchburg St. – 3 year extension request– The Commission wanted to be sure the site was being stabilized and continued this item to the June 5, 2003 meeting agenda.
Correspondence/New Business/ Discussion
§ Site Inspection at 48 Fitchburg St. – James Mongeau was present. Ed Clancy read a letter from Ms. Ryder dated April 29, 2003 regarding the site inspection with Mr. Mongeau at 48 Fitchburg St. held on April 25, 2003. Mr. Mongeau explained that he wanted the ROW pipe to be cleared to allow for passage of water through the site. He also believed that a channel should be constructed through his property to allow the water to flow through more quickly. Mr. Mongeau requested that the Commission issue a Cease and Desist Order on DEP 212-802 Road A project, until the issues on his property have been addressed.
Chairman Clancy indicated that he did not feel that a Cease and Desist Order was justified at this time, but that the Commission would continue to work with Mr. Deli Priscoli to ensure they are in compliance with the Order or Conditions and would seek a response from the site engineer regarding the issues raised regarding the stilling basin, the groundwater information and the basin design as outlined in the site inspection memo. The Commission determined that the site engineer should provide a response by the May 15th meeting.
§ DEP 212-762 Villages at Crane Meadow (Williams St.) – Unit 72- Deck
Ms. Ryder noted that the deck on this unit had been built on the wetland side, in violation of the Order of Conditions, which specifically noted where the deck was to be installed. The Commission asked that the applicant attend the May 15th meeting and provide a surveyed plan stamped by a professional Engineer or Land Surveyor, as well as a mitigation plan.
The Commission reviewed the following correspondence and voted to accept and place on file:
§ CSX Transportation – 2003 Vegetation Control Program
§ 69 Amory Rd., - Tree removal and patio repair request. The Commission determined that he should file a Request for Determination for this work.
