Discussion
§ Phragmites Control – Donald Lynch Blvd.- Michael Slazik presented their proposal to Rosewood Construction from Leah Basbanes of Basbanes Associates, dated July 2, 2003. The Commission reviewed the proposal and after some discussion determined that the additional items should include ongoing monitoring, adding the city to be listed as an additional insured in the herbicide application, and required pre and post-treatment survey of the phragmites on the property. In general, the Commission agreed that the plan was okay and requested that Priscilla Ryder draft a set of amended conditions for the Commission’s review of the next meeting
on July 17th.
§ The Desert – beaver dams on trail. Ms. Ryder indicated that beavers have blocked the main access road into the Desert Conservation land, which is old Concord Road. The dam is now over 100 ft. long and 2 feet high of on both sides of the old roadway. Ms. Ryder requested that the Commission take a look at this and determine if repairs should be done now or after the beavers have gone in a couple of years. The Commission agreed to check it out.
§ J.P. I – results of site walk. - Edward Clancy, John Skarin, Dennis Demers and Priscilla Ryder were present at this site walk. A summary of the sitewalk was reviewed and placed on file.
§ Walnut Hill Water Treatment Plant, DEP 212 – 692. The commission review the letter dated June 25th 2003 from Earth Tech regarding the installation of a security fence at the diversion structure. The Commission approved of the letter and placed it on file.

Request for Determination of Applicability
26 Daley Circle – Andrew Shapiro
Mr. Shapiro was present and described the installation of the shed and the addition of a small amount of lawn at his existing house. The shed would be located next to the stream. Edward Clancy indicated he had seen the site and as long as there is no encroachment into the wetlands, beyond that marked in the field, the project was fine. After some discussion. the Commission closed the hearing and voted 6-0 to issue a negative determination with the condition that the Conservation Officer be notified prior to construction.

53 Bergeron Road – Mike Farrell
Mr. Farrell and his representative Glenn E. Krevosky of EBT Environmental Consultants provided a modified plan dated July 10th, which includes the addition originally proposed, plus a deck and a pool. He will be submitting an additional filing fee for these two additional pieces to the project. All excess material from the site will be removed from the site. The Commission determined that additional grading on the plans was necessary to determine the depth of the pool in relation to the ground water table on the site and whether dewatering would be necessary. The Commission requested that the applicant return to their Aug. 7th meeting with additional elevations on the plan, the dewatering system, to be used and some indication of what type of filter system
will be used for the pool. The Commission continued to hearing to Aug. 7th.

off Fitchburg Street, culvert replacement - Dept. of Public Works
Patrick Clancy, City Engineer, explained the project which involves removal of a culvert and the replacement of the culvert with the channel to restore the flows from the pond down stream. Flows will not be increased, as the bottom of the channel will be the same elevation as the old culvert. The work should take one day and will be designed as shown on the plan. Sand bags will be used, if needed, to help control the flow of water through the work area. They hope to do this work when the water level is low. The Commission requested that the sandbag dam, if used, be removed slowly in stages to eliminate any scouring. The Commission requested that the work begin when no rain is anticipated and be done in the beginning of the week in case the project extends more than a
day or two. The abutter, Mr. Mongeau, asked when the work would be done. Patrick Clancy indicated it should be done by the end of the summer, depending on who does the work. Lawrence Roy reminded everyone that this drains to a trout brook, which is of special concern. There being no further discussion, the hearing was closed and a draft set of conditions will be reviewed at the July 17th meeting.

207 Berlin Road – Brad Bumpus (Nobel Construction)
Timothy Paris of Connorstone Engineering described the three-lot subdivision shown on the plan. The only work within the 100 ft. buffer zone are drainage pipes and the detention basin. Ms. Ryder indicated that she would need to verify the wetland boundary. Patrick Clancy indicated he had comments through the Planning Board which will require the re-reconfiguration of the basin. The Commission requested additional erosion controls to control runoff onto Berlin Road, a construction entrance pad, and adjustments to the detention basin as required by the City Engineer. With the applicant’s consent, the hearing was continued to August 7th.

Crane Meadow Rd. (Fairfield Green at Marlborough) – FF Development LP
John Twohig of Goulston & Storrs, Brendan Quigley of Rizzo Associates and Andrew Montelli of Fairfield were present. John Twohig explained that he had provided a draft Order of Conditions that Priscilla Ryder has amended and the Commission has copies of. Two issues from the last meeting were: to get an update from the Southboro Conservation Commission and from our City Engineer Patrick Clancy. Ms. Ryder indicated that Southboro is still waiting for a response from Rizzo Associates regarding issues raised by their independent engineer. John Twohig explained that all the issues raised, which pertain to Marlborough, have been addressed. The level spreader has been shifted so that it will not erode the slope.
Patrick Clancy indicated that he had some questions about the detention basin construction and proposes that the embankment will be placed on blasted ledge. This connection between the fill and the blasted ledge needs to be keyed into the ground, so there is no way for the water to seep between these layers. Patrick Clancy indicated this particular detail could be provided during the Site Plan Review process. This would satisfy his concerns about this project in general. He still needs to review the drainage design in more detail.
The Commission reviewed the draft order, and added a condition relative to the pool treatment method and water discharge, which will be included in the ongoing maintenance plan. There being no further discussion the hearing was closed. The Commission voted 6-0 to issue the Order of Conditions as amended.
Notice of Intent (Continuation of Public Hearing)
600 & 800 Nickerson Rd. – Glenborough Realty Trust
Representing the applicant was Shawn Clinger of Beals Associates. He indicated that the latest plan revisions were June 7th and included changes recommended by the City Engineer, Patrick Clancy. He reviewed the changes, which included parking spaces, landscaped islands, maintenance access on detention basin, erosion control plan, changes to the O & M plan, and revised drainage calculations. The pipe draining into the pond was considered to be o.k. After further discussion, the Commission continued the hearing to August 7th to allow for the additional changes to be added and to receive comments from Patrick Clancy as to the adequacy of the changes presented tonight.
Draft Orders of Conditions
§ Lot 3 Danjou Dr. – The Commission reviewed the draft order. The Commission voted 6-0 to approve the draft order as amended.
§ Lot 4 Danjou Dr. - Ms. Ryder indicated that Bob Parente, the project engineer, had provided a revised plan for the Commission’s review. The Commission reviewed the plan and indicated that this plan was substantially different from the plan presented at the last hearing with block walls next to the vernal pool, and more clearing close to the abutter’s property. Mr. Fossile will need to request an amendment to his Notice of Intent and notify abutters so that the hearing can be re-opened. Ms. Ryder will convey this and will suggest that a new hearing be opened on August 7th or if they want to go forward with the
original plan. The Commission can review the draft order at the July 17th meeting. The draft Order was not reviewed.
§ 183 Lakeshore Dr. - The Commission reviewed the draft order. The Commission voted 6-0 to approve the draft Order as written.
§ 20 Mosher Lane, (Lot 10) - The Commission reviewed the draft Order. The Commission voted 6-0 to approve the draft Order as written.
Certificate of Compliance
§ DEP 212-258 77 Robert Rd. (Lot 46A) Country Club Estates - This lot is not affected by wetlands, the Commission voted 6-0 to issue a partial Certificate of Compliance for this lot.
Extension Permit
§ 212-806 – 84 Waterford Dr. (Waterford Park Development), the Sepracor site - After some discussion the Commission voted 6-0 to issue a 2-year extension, (rather than the three year extension requested.)
