DISCUSSION
§       DEP 212 – 777 Thoroughbred Acres Subdivision - The Commission discussed the letter sent to Tim LaFreniere regarding the submission of a check to the Conservation Commission’s Conservation Maintenance Fund in the amount of $1100 in place of planting seven trees.  Ed Clancy explained that he agreed to this mitigation for the tree replacement.  The area where the trees were to have been planted is already over grown with native plants and trees and no further planting is needed to “naturalize this area” as required by the Condition of the Order.  After some discussion the Commission voted 6-0 to approve the changes to the Order of Conditions as noted in the letter.

§       DEP 212 – 774   Pleasant Street cross-country sewer – Ms. Ryder noted the drainpipe had been installed for construction across the wet area on this property.  This had not been removed and the developer was wondering whether it should be removed or whether if it was necessary for maintenance of the sewer line. The Conservation Commission noted that this was part of the Conditions of the Order and the pipe should be removed and the grading restored to pre-construction conditions.  Ms. Ryder will notify the contractor.

§       DEP 212 – 802   Follow up from Bruce Saluk on corrective measures, Road A Fitchburg Street Crowley Drive -  The Commission received a letter from Bruce Saluk outlining the corrective measures that have been completed to date.  Ms. Ryder inspected the site.   The only remaining items that were not done, was the removal of the erosion controls, and the work on Mr. Mongeau’s property, because an agreement between these parties has not been reached.

PUBLIC HEARINGS
Request for Determination of Applicability
60 Berlin Rd. (Lot 17B) – Allan White
Allen White abstained from this discussion since it is his project.

Allan White presented the plan drawn up by Robert Parente, his project engineer,  who could not be present.  The plan shows a house 87 ft. away from the wetland at its closest point.  The 100 ft. buffer zone is shown on the plan, hay bales will be placed to control runoff from the site and the remainder of the lot will be left undisturbed.  Stock pile  material will be placed between the two lots up near Berlin Road and no work will be done beyond the erosion control barriers.  Ms. Ryder noted that all the work is also outside the 50 ft. no disturb buffer zone established by the Water Supply Protection District.  After some discussion, the Commission closed the hearing and voted 5 – 0 to issue a native determination with the conditions to notify the Conservation Officer prior to construction.

66 Berlin Rd. (Lot 17A) – Allan White
Allan White abstained from discussion since this is his project.

Allan White presented a proposal drawn by Robert Parente, his site engineer.  This house is over 100 ft. away from the brook.   It is outside the wetland buffer zone.  However, Allan White wished to present this to the Commission to be sure further review was unnecessary.   The stream itself is 75 feet to the property line for this lot.  The Commission determined that this is not a jurisdictional project and voted 5-0 to issue a negative determination noting that there is no jurisdiction.

DRAFT ORDERS OF CONDITIONS
§       53 Bergeron Rd. -  The Commission reviewed the draft Order of Conditions for the addition and pool construction.  The Commission voted 6-0 to approved the draft Order as written.

§       Lot 4 Danjou  Dr. – Crystal Ridge Realty Tr. -  The  Commission reviewed the draft Order and added one more condition:  That all work be done outside the 30 ft. buffer zone including the wall placement.  The Commission voted 6-0 to issue the draft Order of Conditions as amended.

CERTIFICATES OF COMPLIANCE
§       DEP 212-876  Target Store – Donald Lynch Blvd.
Ms. Ryder reported she made a site inspection, the As-Built Plan has been provided, detention basin and catch basins have been cleaned.  However, the infiltration system had not yet drained from the rainstorm and still needs to be inspected.  The Commission voted 6 -0 to issue a Certificate of Compliance to be held until infiltration system has been inspected.

§       DEP 212-856  111 Cullinane Dr. – Ms. Ryder noted that the site has been stabilized and has met all the Conditions of the Order.  The Commission voted 6-0 to issue a Certificate of Compliance.

§       DEP 212-313  209 Blanchette Dr.  -  Ms. Ryder noted that this parcel is outside any wetlands jurisdiction, but was recorded on the lot.  The Commission voted 6-0 to issue a PARTIAL Certificate of Compliance for that lot only.



EXTENSION PERMIT
§       DEP 212-802   Fitchburg St. Road A (Crowley Dr).  The applicant’s representative from Oxbow Associates was present.  They had sent a letter on behalf of MetroPark Corp. requesting a three year extension for the bike path and roadway project.  The remaining items are the final planting and paving which will take some time.  The Commission voted 6-0 to issue only a 2 year extension for this project.

CORRESPONDENCE
The Commission read all the correspondence and voted 6-0 to accept and place on file.

ADJOURNMENT
The public meeting was adjourned at 8:45 pm.
