Zoning Board of Appeals
Minutes
May 4, 2011
Landuse Meeting Room
Members present: Chair Ethan Berg, (EB); Cliff Snyder, (CS); Robert Fuster (RF); Shawn Leary Considine, SLC; Ned Douglas, ND
Staff present: Land Use Clerk Peggy Ammendola, (PA)
Bruce J. and Linda J. Stringer, 529 Walker Street (Map 38, Parcel 32), Special Permit Section 3.3 or, in the alternative, a variance under Section 9.3 to construct two (2) apartments in an existing building previously used as a carpentry shop and office.
Making the presentation were Rob Akroyd of Greylock Design Associates and
Attorney Jeff Lynch.
Also present were Bruce and Linda Stringer.
RF disclosed that in the past he has represented Bruce and Linda Stringer as well as members of their families, but he feels that he can be objective. No one objected to his participation as a ZBA member.
Mr. Lynch stated that the use of the property is non-conforming as apartments are not permitted in the Commercial Zone, but the proposed two apartments to be located in an existing vacant building, would be next to a pre-existing, grandfathered apartment building. He noted that at a Special Town meeting in 2009 an easement was granted to the former owner to encroach on town property. He pointed out that this use would be taking away a commercial use in which generated traffic.
Mr. Akroyd presented the site plan and floor plans as proposed.
Two letters of support were received from the following:
Tim Sheehan
Bill Colvin
SLC made a motion to grant the petition for a Special Permit under Section 3.3 to construct two apartments. RF seconded the motion and the Board voted to agree 5-0.
Cranwell Resorts, LLC, Phillip Heller to discuss the rebuilding of the Carriage House destroyed by fire December 22, 2010. This request was canceled by Attorney Heller on April 29, 2011.
Respectfully submitted,
Peggy Ammendola
