Members present:  Chair Pam Kueber, PK; (CS); Ethan Berg, (EB); Clifford Snyder, CS; Shawn Leary Considine, (SLC); and Ned Douglas, ND

Staff present: Land Use Clerk Peggy Ammendola, (PA)

Jennifer Sagalyn 40 Sargent Brook Road (Map 1, Parcel 29). Special Permit Section 3.3.3, or in the alternative a Variance from Section 3.3.4, to construct an addition to the existing screen porch. Continued from October 7 and October 21, and November 4, 2009.

Present was Rob Akroyd of Greylock Design Associates, who represents the petitioner.   A letter received November 4, 2009 from Andrea Winter was read into the record.  Ms. Winter supports Ann Philips, an abutter to Ms. Sagalyn, in her objection to this petition.

There were four abutters present as well as Attorney Bill Barry who represents Anne Philips.  

SLC made a motion to close the public hearing and ND seconded the motion.  

SLC made a motion to grant the petition as presented and ND seconded the motion.  

SLC made a motion to amend the motion to grant a special permit ND seconded.

The Board voted 0-5 to grant the petition.  SLC will be writing the decision.  


Frank and Loraine S. Tabakin 33 Hubbard Street (Map 47, Parcel 21), Variance~from Section 3.3.4 to construct a new detached garage. Continued from October 7 and October 21, 2009.Continued from Nov. 4, 2009 to November 18, 2009as there were only three members available.  SLC had a conflict on Nov. 18, therefore this hearing continued again to December 2, 2009 at 7:15 pm.

Donna Collins, an immediate abutter, was present.  

A plan received on November 4, 2009 was presented by Mr. Tabakin to the Board.  The setbacks are now 15 feet and there is 2.6 percent more coverage than the 20 percent.

Paul Marshall wrote a letter of support for the plan received on November 4 that was read into the record.   

Donna Collins spoke has a concern regarding garage access and potential for more drive giving up a view and fears her property value will decrease.

The Board agreed that they should have a site visit and scheduled this for December 5, 2009 at 10:00am.

The hearing is continued to December 9, 2009 at 7pm.
