439 Pittsfield Road, LLC, Map 33 Parcel 1, 439 Pittsfield Road, Review of modification of placement of sign. Eric Taylor, owner of the property, stated that the existing concrete base is not adequate for the support of the new sign, and is seeking the approval for relocating the sign eight feet to the south. This is the only change requested.
Discussion ensued and the Board felt that this modification is de minimus and therefore
approved Mr. Taylor’s request.
Frank and Loraine S. Tabakin 33 Hubbard Street (Map 47, Parcel 21), Variance~from Section 3.3.4 to construct a new detached garage. Continued from October 7 and October 21, 2009.Continued from Nov. 4, 2009 as there were only three members available on Nov. 4, 2009
SLC was not present at this meeting. Therefore Mr. Tabakin requested that this hearing be continued again to December 2, 2009 at 7:15 pm
7:00 pm John and Michelle Tran, 274 Pittsfield Road (Map 27, Parcel 75). Variance under Section 3.3.4 or in the alternative a Special Permit under section 3.3.5 to allow the addition of a garage to a pre-existing single family house that will create a new nonconformity.
The Trans presented a petition to the ZBA on February 24, 2009 for a garage on the north side of their property, but their request was denied. (Decision was filed May 14, 2009) The Trans wanted to file another appeal to the ZBA before two years lapsed and as is required by MGL, they petitioned the Planning Board for permission to re-submit. On October 28, 2009, the Planning Board voted 5-0 to give its consent for the resubmission to the Zoning Board and provided a letter to that affect. The proposed new location is on the south side of the property.
Making the presentation was John Tran and his contractor, Vince Carchetti.
Mr. Carchetti provided the Board with a site plan of the new proposal.
In a letter dated October 27, 2009, Katherine and Tom Shoemaker, the direct abutters to north of the Tran’s property, stated that they support the petitioner’s request for a new garage on the north side.
There were no abutters present.
CS made a motion to close the hearing and ND seconded. The motion carried 5-0.
CS made a motion that the Board grant a Variance pursuant to Section 3.3.4, with the following conditions: The street line setback shall be no less than sixty feet; the lot line setback shall be no less than twenty feet and the height of the garage shall be no more than eighteen feet. ND seconded the motion and the Board voted in favor 5-0.
