Selectmen's Minutes 05/17/2017
Minutes of Meeting – May 17, 2017; meeting called to order at 7:00pm.  Present:  Channing Gibson; Ed Lane; Ken Fowler; Warren Archey; Dave Roche.
The Chairman announced the Memorial Day events.  MOTION by EL, seconded by CG to accept the Minutes of May 3.  5/0 vote.  Citizen’s Open Forum: None.

Consent Agenda:  MOTION by EL, seconded by CG to approve the consent agenda as follows: one-day W&M license to Shakespeare & Co. for Friday, 5/26 from 4:30-8pm at Ventfort Hall; one-day W&M license to the Lenox Library for Saturday, 5/27 from 4-6pm; one-day W&M license to Ventfort Hall for Saturday, 5/20 from 6-8pm; one-day W&M license to Renee Keator for Sunday, 6/4 from 1-7pm at St. Ann Family Center; one-day W&M license to Timothy Blair for Saturday, 6/17 from 1-5 in the Community Center Ballroom; one-day W&M license to Susan Baum for Saturday, May 27 from 5:30-11pm at Ventfort Hall; permission for Mass Audubon to hold their Wild Thing 5K/10K Trail Race on Sunday, June 25 from 9-10:30am.  5/0 vote.  MOTION by EL, seconded by CG to grant a one-day W&M license to the Lenox VFW for Monday, 5/29 from 1-3pm at the Academy Building.  5/0 vote.  MOTION by EL, seconded by CG to grant a one-day W&M license to the Lenox Dale Fire Company for Monday, 5/29 from 6pm-midnight at the Lenox Dale Fire Station.  5/0 vote.
MOTION by EL, seconded by DR to ratify the appointment of Brenda Marra to the newly created position of Treasurer/Collector, effective July 1, 2017.  5/0 vote.

MOTION by EL, seconded by DR to grant permission to the Columbia University MFA Film students to film on the cemetery property adjacent to the Church on the Hill property for two days during the week of June 5, 2017.  5/0 vote.

Use of Town Property for the Farmer’s Market:  St. Ann’s Church agreed to host the farmers market on their front lawn during the summer, except for the one weekend in July (July 14) when they will be holding their summer event.  After a brief discussion, MOTION by EL, seconded by DR to grant permission for the farmers market to hold their event in Roche Reading Park, but not on the grassy area between the road and sidewalk, on the one Friday in July (July 14) when the church property is unavailable.  5/0 vote.

Attorney Val Romano, attorney for Crane Healthcare, Inc., appeared before the Board to make a presentation regarding the siting of a medical marijuana facility in the Town of Lenox.  He explained that his clients will provide high quality cannabis to qualified medical patients, and that they anticipate having approximately 25 employees.  As part of the process, they are looking to have the Board sign a letter of support or of non-opposition for a medical marijuana facility to be located in Lenox.  This is the first step in order to move forward with the application process.  DR questioned why they want to do this for 400 people in Berkshire County.  He then suggested that a meeting be scheduled in Lenox Dale to hear what the residents have to say.  KF reminded everyone that the area in question is an ACEC (Area of Critical Environmental Concern) site.  WA suggested that the Police, Board of Health, ZBA and Planning Board weigh in on this issue.  CG questioned them about their timeframe, to which they stated that they are ready to move forward now.  

MOTION by KF, seconded by EL to elect Dave Roche as chairman.  5/0 vote.  MOTION by KF, seconded by EL to elect Warren Archey as clerk.  5/0 vote.

BOS liaison reports:  CG stated that there have been delays in the beach renovations project, and that it now makes sense to hold off work until the fall.  The CPC held their public meeting seeking input on the CPA priority projects for the Town.  Those mentioned included repair of the water trough, a town-wide pathway, dog park and Baker’s Pond.  He felt that the ATM was very successful, and that we need to continue to work on the TIF/STA proposal.  DR stated that he would like to have a joint meeting with the Lee Selectmen set up sometime in the future.  He then announced the Memorial day events and a gathering of Lenox High alumni at the library this Saturday.  WA stated that six red maple trees have now been planted in town.  EL stated that paving of Richmond Mountain Road should be completed tomorrow.  KF reminded everyone that the plastic bag and Styrofoam ban goes into effect on June 10.  Meeting adjourned at 8:20pm.
