Selectmen's Minutes 11/02/2016

Minutes of Meeting – November 2, 2016; meeting called to order at 7:00pm.  Present:  Warren Archey; Ed Lane; Channing Gibson; Dave Roche; Ken Fowler.
 
The chairman reminded everyone who has not yet voted to get out and vote on Tuesday, 11/8.

MOTION by EL, seconded by DR to accept the Minutes of October 28.  4/0 vote with KF abstaining.

Consent Agenda:  A Hold was placed on the Community Center Board Appointment.  MOTION by EL, seconded by DR to approve two craft fairs in Lilac Park during the summer:  Church on the Hill 7/29-30 and Lenox Youth Basketball 8/11-13; to Lynn Horvath, Richmond West Stockbridge Artists’ Guild, a 14-day temporary banner for the Library; 2) a few street signs; 3) small arrows near the Library walkways; and 4) a mannequin/strawman artist on Library property to advertise an art show.  The 14 days will run from 11/23-12/7; and a one-day W&M license for Saturday, November 26, 2016 from 2-5pm for the art opening at the Welles Gallery; a one-day W&M license for Saturday, November 12, 2016 from 6-8pm at St. Ann Parish Center for their Veterans’ Day dinner.  5/0 vote.  CG thanked Jen Picard for stepping up and offering to serve on the Community Center Board.  MOTION by CG, seconded by DR to appoint Jenifer Picard to the Community Center Board.  5/0 vote.

The TM asked the Board to move his report until after the public hearing to accommodate those in attendance for the hearing.  

Public Hearing – The Board was presented with three separate A/A restaurant licenses that are seeking amendments to their licenses:  Ferelle, LLC d/b/a Alta Restaurant & Wine Bar is seeking a change of manager and LLC members; Lenox Restaurant Group, Inc. d/b/a Church Street Café is seeking a change of manager and new officer/director; Gabagool, LLC d/b/a Frankie’s Restaurante Italiano is seeking a change of manager and LLC members.  Since all three licenses are held by the same individuals, the Board agreed to combine this into one hearing.  MOTION by EL, seconded by DR to open the public hearing.  5/0 vote.  EL then read the legal notice as it appeared in the newspaper.  Stephane Ferioli from Church Street Café gave a brief explanation of what changes are being requested.  MOTION by EL, seconded by CG to close the public hearing.  5/0 vote.  MOTION by EL, seconded by CG to approve the above amendments as requested.  5/0 vote.

Special Counsel Grandchamp informed the TM that he had received verbal acceptance of the P&S agreement between the Town and Jacklyn Peters for property located on Willow Creek Road.  MOTION by EL, seconded by DR to approve the Purchase & Sale Agreement between the Town and Jacklyn Peters for property located on Willow Creek Road and to authorize the Chairman to execute said P&S Agreement.  5/0 vote.  The TM then stated that he is still not prepared to ask the Board to call a Special Town Meeting until the P&R is fully executed, at which point he would like to schedule a special BOS meeting to schedule a Special Town Meeting to be held by the end of November.

Rest of River: The TM and WA attended a meeting of the ROR Committee yesterday.  Discussion will occur under the Executive Session portion of the meeting.

Solar Projects: KF stated that clearing work has begun at the landfill site, and that they are getting ready to work on completing the capping before winter.

BOS Liaison Reports:  KF reminded everyone that early voting ends on Friday, November 4, and that the polls will be open on Election Day from 7am-8pm.  He mentioned that Water/Sewer bills will be mailed out 11/4 with a 12/5 due date.  EL mentioned the pipe break at the corner of New Lenox Road and Rte. 7 earlier in the week; the contractor at the Henry Avenue pump station is wrapping up their work for the winter; Richmond Mtn. Road project continues to move along; gravestone repair work is occurring in Mountainview and Church on the Hill cemeteries.  DR mentioned that the 250th celebration gets kicked off on Saturday evening with a dinner and auction at the Lenox Club.  He also thanked the townspeople for their support over the years for the veterans.  CG stated the temporary boiler at the Community Center is up and running while work on the permanent fixes continues.  He attended a BRTA meeting and was impressed with the work they do.  He mentioned that Greyhound Bus lines will be running a bus between Pittsfield and Albany, with a 7am Pittsfield leave time.  The CPC will be meeting on Monday evening to discuss the five 2nd round applications.  Finally, he met with the Chamber and 1Berkshire regarding the Town’s marketing effort, and ok’d our ad in The Guide Book.  By roll call, CG, EL, DR, WA and KF voted to go into Executive Session at 7:25pm to discuss strategy relative to potential litigation.
