Minutes of Meeting – March 4, 2009; meeting called to order at 7:00 pm.
Present: L Messana; J McNinch; KR Flynn. Absent: RN Sandlin; S. Pavlosky.
MOTION by KRF, seconded by JM to accept the Minutes of February 18 as presented. 3/0 vote.
MOTION by JM, seconded by KRF to estimate the seasonal residential population at 10,000 for purposes of seasonal alcoholic licenses. 3/0 vote.
MOTION by KRF, seconded by JM to grant a one-day W&M license to St. Ann Church for 3/21 from
6-9pm at the Family Center. 3/0 vote. MOTION by JM, seconded by KRF to grant a one-day W&M license to Berkshire Lyric Theater for 3/15 from 5-7pm at the Trinity Church Parish Hall. 3/0 vote.
The Board proceeded to go through the six warrant articles for the upcoming March 24 Special Town Meeting. The first five deal with zoning issues, and the sixth one is a transfer of $300,000 from Highway to School Capital that corrects an oversight that was part of a bond voted on last May. Article one proposes replacing the existing Open Space Residential Development bylaw with a new Open Space Flexible Development bylaw as an overlay to the R-1 district. Article two amends the official zoning map to include the Flexible Zoning overlay. Article three proposes to add a new Inclusionary zoning provision to our bylaws. Article four proposes to add as a by-right use a “Great Estate Inn” along with outdoor events for up to 175 people. Article five proposes to clean up language in section 9.3.2 of
the bylaws by removing the phrase “for which no permit is required”. MOTION by KRF, seconded by JM to accept the warrant as presented. 3/0 vote.
Old/New Business: LM read two letters the Board received in opposition to the Farmer’s Market being at Triangle Park this coming summer. She thanked the DPW, Police, Fire and Ambulance for their hard work during this difficult and long winter.
By roll call, LM, KRF and JM voted to go into Executive Session at 7:35 p.m. to discuss negotiations with Pittsfield regarding a new sewer contract.
