Selectmen's Meeting Minutes, 01/21/2009
Minutes of Meeting – January 21, 2009; meeting called to order at 7:00 pm.  
Present:  RN Sandlin; L Messana; J McNinch; KR Flynn; S. Pavlosky.
MOTION by KRF, seconded by LM to accept the Minutes and Executive Minutes of January 7 as presented.  5/0 vote.

Rose Levine, representing the Farmer’s Market, appeared before the Board to request the use of Triangle Park and the short spur road on the northern side of the park to host their farmer’s market this summer.  The Farmer’s Market would be held on Fridays from 2-6pm from Memorial Day through Columbus Day, and vendors would be asked to park in the public lot behind the Legacy Bank building.  It was noted that when a large crowd is expected at Tanglewood, an earlier closing time for the market may be needed.  Also, strict enforcement of the current parking rules on Cliffwood Street will be important.  The market organizers agreed to cooperate fully on these matters.  MOTION by RNS, seconded by LM to grant permission as requested.  5/0 vote.

MOTION by RNS, seconded by LM to grant a one-day A/A license to Eastover Resort for Saturday, 2/7 from 5:30pm-midnight at Tally Ho.  5/0 vote.  MOTION by RNS, seconded by LM to grant a one-day A/A license to Eastover Resort for Sunday, 2/22 from 2-10pm at Tally Ho.  5/0 vote.  MOTION by RNS, seconded by KRF to grant a one-day A/A license to Eastover Resort for Tuesday, 3/17 from 7:30pm-1am at Tally Ho.  5/0 vote.

MOTION by JM, seconded by KRF to grant a Taxi license to BEAE, Inc., d/b/a Berkshire Executive Airport Express, 27 Church Street.  5/0 vote.

ACEC:  KRF disclosed that she is employed by Phil Heller who is representing Interstate Biofuels.  She stated that she feels that she could act fairly and unbiased on this issue, but asked if anyone had a problem with her sitting in on these proceedings.  Eleanor Tillinghast, Green Berkshires, Inc. stated that she would feel more comfortable if KRF recused herself.  Accordingly, KRF proceeded to move to a seat in the audience.  Ms. Tilinghast proceeded with her presentation, stating that she feels that the original boundary should not be amended.  She feels that if you amend it for one location, then the next location may ask to be excluded, and so on.  She stated that she does not feel that including all of the industrial land in the ACEC will in any way have a negative effect on a proposed new business entering the Niagara Mill property.  SP stated that he wants to make sure that Lenox Dale is not negatively impacted.  

Attorney Phil Heller spoke on behalf of his client, Interstate Biofuels.  He stated that to exclude the Niagara Mill will create a lobe of approximately 400 acres.  He is proposing the boundaries go from Walker to Elm to Crystal to Washington Mountain Road.  He went on to say that this is a $30M project which will create 35-40 new jobs.  Including this property in the ACEC would add another 6-12 months to the process at a cost of $75-$100,000.

Ms. Tillinghast stated that she will review the boundaries, and explain why they are significant, and why excluding all industrial land is not necessary.

Old/New Business:  LM went through the employee anniversaries.  RNS mentioned that the Tri-Town Rotary may be willing to participate in establishing a new playground at Orebed Park.  SP informed the Board that the Olde Heritage Tavern was voted #5 in the nation for Quality of a Guinness Pour, and that they are requesting permission to erect a temporary banner on the front of their building to that effect.  MOTION by LM, seconded by KRF to grant said permission for a two-week period.  4/0 vote with JM abstaining.  He reminded everyone that we need to schedule a budget forum.  He also informed the Board that he and the clerk had signed a letter to Greylock Design regarding the Lenox Gateway project.

By roll call, SP, LM, RNS, KRF and JM voted to go into Executive Session at 9:35 p.m. to discuss current negotiations with personnel.
