Minutes of Meeting – April 30, 2008; meeting called to order at 5:00 pm.
Present: S Pavlosky; L. Messana; JH Pumphrey; RT Akroyd; RN Sandlin.
Under Citizens Participation, Chamber Director Ralph Petillo and Rudy Caligari appeared before the Board to discuss the possibility of the Town adopting a by-law to govern sales from the back of trucks. The Board asked if he had any models that the Town could look at, and that we could then refer this issue to Town Counsel.
MOTION by RTA, seconded by SP to accept the Minutes of April 16 as presented. 5/0 vote.
MOTION by JHP, seconded by RTA to appoint Mike Smith as a full-time regular police officer for the Town of Lenox effective April 25, 2008. 5/0 vote.
MOTION by JHP, seconded by RTA to award the bid for drainage work on Ore Bed and Housatonic Streets to Caracus Construction in the amount of $346,214 and to authorize the TM to sign a contract for same. 5/0 vote.
MOTION by JHP, seconded by LM to grant permission for a temporary sign permit to Ann Jon to erect a sign on the grass to the west of Town Hall from June 1 through October 31. 5/0 vote. (Note: The Planning Board voted in the affirmative regarding this sign as well.)
Appointments: MOTION by JHP, seconded by LM to table the annual appointments until the next meeting. 5/0 vote.
MOTION by RTA, seconded by JHP to renew the lease with Aspinwall Riding Stables for an additional 3-year period. 5/0 vote.
MOTION by JHP, seconded by LM to grant a one-day A/A license to Eastover Resort for 5/16 from 5:30-11:30pm at Tally-Ho. 5/0 vote.
At 5:30, SP reminded the TM that we need to set up a public forum with EPA regarding the Rest of River clean-up project. He then exited the meeting.
Reservoir Road Public Hearing: RTA opened the public hearing regarding the abandonment of Reservoir Road from the intersection of the old Dunbar Road west to the town line with Richmond by reading the advertisement as it appeared in the newspaper. DPW Superintendent Jeff Vincent explained to the Board the need to close the road in order to protect the public water supply. He went on to say that he would rather close the road near West Mountain Road to try to avoid the dumping that occurs in the ravine. It was agreed, however, that this was a first step and that the Town could look into this option at a later date. Residents from Richmond questioned if the gate would be at the top or bottom on the hill at the Town line, to which the Board stated that it could be at the top if Richmond voted to close this road,
otherwise it would be at the Lenox Town line. Planning Board Chairman Joe Kellogg stated that the Planning Board concurred with the Board’s request to abandon this portion of Reservoir Road. Hearing no other comments, MOTION by RTA, seconded by JHP to close the public hearing. 4/0 vote. To recap the hearing, MOTION by RTA, seconded by LM to endorse the proposal to abandon Reservoir Road from the intersection of the old Dunbar Road west to the town line with Richmond. 4/0 vote. RNS explained that with this public hearing held, there is now language on the upcoming ATM warrant to seek approval from the voters to abandon this portion of the road as well.
Old/New Business: Board members thanked JHP for her 15 years of service, and wished her luck in her future endeavors. The Board briefly discussed what to do should the ATM need to be reconvened to another date and time. It was agreed to schedule any remaining articles as a Special Town Meeting.
