Selectmen's Meeting Minutes, 10/10/2007
Minutes of Meeting – October 10, 2007; meeting called to order at 5:30 p.m.  
Present:  RN Sandlin; L Messana; RT Akroyd; S Pavlosky; JH Pumphrey.

MOTION by RTA, seconded by LM to accept the Minutes of September 26 as presented.  5/0 vote.

Ken Fowler, Chairman of the Historic District Commission, appeared before the Board to discuss the Boards frustration with violators of their regulations, especially regarding signage.  There are more violators than ever before.  The Selectmen pledged their support in any way that could help the board out.  It was agreed to send a letter to all tenants and landlords located in the historic district referencing guidelines available on-line, have the guidelines available at the clerk’s office and distribute to businesses when they come in for their business licenses, work on re-writing the by-law, especially regarding signs (JHP to assist), and for violations, the HDC will write a formal complaint to the building inspector who will be responsible for enforcement.

The Board presented Fire Chief Dan Clifford with a citation recognizing him as the 2007 MA Emergency Manager of the Year.  Following the presentation, Dan updated the Board on activities in the Fire Department.  He explained that he is working with the clergy on a shelter plan, that calls are down, but their seriousness is up, that they are finalizing the Emergency Dispensing Plan and the Town is now NIMS compliant, making us eligible for grants.  RTA asked to have MED send a letter to Scott Dupont who recently resigned from the Fire Department.

MOTION by JHP, seconded by RTA to grant a one-day A/A license to Ventfort Hall for 10/20 from
9-11pm.  5/0 vote.  MOTION by JHP, seconded by RTA to grant a one-day A/A license to Ellen Pollen for 11/10 from 7:30-11:30pm at the Community Center Ballroom.  5/0 vote.  MOTION by JHP, seconded by RTA to grant a one-day W&M license to Joanne Lane for 11/10 from 3-7pm at the Community Center Ballroom.  5/0 vote.  MOTION by JHP, seconded by RTA to grant an A/A license to Michael Steuerwald for 10/12 from 5-9pm at the Community Center Ballroom.  5/0 vote.  MOTION by JHP, seconded by RTA to grant a one-day W&M license to Maria Caccaviello for 10/20 from 5-8:30pm at the Berkshire Scenic Railway.  5/0 vote.

MOTION by JHP, seconded by LM to accept a seized vehicle for use in Police business with the stipulation that funds to maintain the vehicle must come from the drug unit only.  5/0 vote.

MOTION by RTA, seconded by JHP to award engineering work for the Ore Bed/Housatonic Street Drainage Improvements project to Foresight Land Services in an amount not to exceed $18,000 and to authorize the TM to sign a contract for same.  5/0 vote.

MOTION by JHP, seconded by RTA to appoint Roscoe Sandlin as a member of the Community Preservation Committee, replacing Rob Akroyd who resigned.  5/0 vote.  RNS mentioned that his wife also serves on the committee, and that he checked with the Attorney General’s office and there is no problem with them both serving on this board.

Old/New Business:  LM went through the employee anniversaries.  RNS brought up a letter that the Town received from the Division of Fisheries and Wildlife wherein they wish to purchase a conservation easement on approximately 949 acres of Lenox Watershed property for the amount of $1 million.  He explained that while there will be a forum scheduled shortly to update the public on this issue, a STM needs to be scheduled so that the Town may accept the state’s offer.  MOTION by JHP, seconded by RTA to set Tuesday, October 30 at 7pm as the date and time to hold a STM to seek approval from the voters to authorize the Selectmen to convey a conservation easement to the Division of Fisheries and Wildlife on the 949 acres of watershed lands owned by the Town.  5/0 vote.  RTA thanked Jeff Vincent, Paul Mahoney and Scott Jarvis for their work on removing the fence at the library and for their help in enlarging Lilac Park.
