Members present: Chair Joseph A. Kellogg, JK; Ken Fowler, KF; Gary Schiff, GS; and Kate McNulty-Vaughan, KMV.
Members absent: Steve Sample, SS
Staff present: Mary Albertson, Town Planner, MA.
The meeting was called to order at 6:01 pm
Discuss and Finalize Report to Town Meeting: MA distributed copies of the draft report. James Biancolo was in attendance and asked for clarification regarding the removal of Section 6.7 –Educational and Religious Uses. Mr. Biancolo asked if there were any plans to replace Section 6.7 with regulations that apply to places of assembly. JK said not at this time. The consensus of the members was the draft report was satisfactory. JK will make the report to Town Meeting.
Discuss Outdoor Dining Regulations: MA said that the ZBA has received a new application to allow outdoor dining. Given the recent sidewalk work in the village, MA noted that it is difficult, if not impossible, for restaurants to meet the existing setback requirements for outdoor dining. Currently, the Zoning Bylaw requires a 5 foot setback from the sidewalk and a 10 foot setback from the street. Members agreed that outdoor dining should be encouraged and discussed removing or reducing the required setbacks. They also agreed to ask the Selectmen to determine if a certificate of insurance from restaurants may be appropriate if the dining takes place on Town property.
Minutes: KF made a motion to approve the minutes of April 3, 2010. KMV seconded the motion and the Board voted 3-0 to approve. GS abstained.
It was noted that the Board will not be meeting on May 11th with the next meeting scheduled for May 25th.
KF made a motion to adjourn the meeting at 6:45 pm. KMV seconded the motion and the Board voted 4-0 to approve.
