Land Use Meeting Room

Members present:  Chair Joseph A. Kellogg, JK, Ken Fowler, KF, and Steve Sample, SS.
Members absent: Kate McNulty-Vaughan, Gary Schiff.

Staff present:  Mary Albertson, Town Planner, MA.

The meeting was called to order at 6:05 pm.

Approval Not Required Plans:  There were no plans submitted.  

Continued Discussion:  
Discussion ensued regarding the proposal to require Site Plan Approval in residential districts for certain size buildings; revised use categories; the removal of Section 6.7, Religious and Educational Uses; and the regulation of off-premises sales.  The consensus of the members was to put draft proposals into writing and begin public outreach meetings to receive input.  It is hoped that public information meetings could be concluded by January 2010, followed by public hearings and a Special Town Meeting in late winter or early spring.  JK and MA will work on the revised use categories.  MA will determine if there are funds available to have Mark Bobrowski review the proposal for revised uses categories.

Minutes:  SS made a motion to approve the minutes of September 22, 2009 with one correction of a typographic error in the paragraph regarding Places of Assembly, and KF seconded the motion.  The Board voted 3-0- to approve.  

BRPC 5th Thursday Dinner – The dinner is October 29 – 6-9 PM at the Berkshire Hills Country Club.  JK, KF and MA will attend the dinner which includes a presentation on the Green Communities Act.  The Town has applied to receive assistance through the Green Communities Act program and JK offered to serve as the Planning Board liaison for this program.  
 
New Business:  JK informed the members that there are new state ethic regulations which require all members to certify that they have received a summary of the conflict of interest law, available from the Town Clerk, and complete an online training program.  Members must complete these tasks by December 28, 2009.    

JK explained that the Board has received a repetitive petition appeal under Mass. Gen. L. ch. 40A, Section 16.  Recently, the Zoning Board of Appeals (ZBA) denied a special permit request to construct an attached garage for property located at 274 Pittsfield Road.  State law prohibits the property owner from filing a new application for two years unless the Planning Board gives their consent.  The Board will hear this request at its October 27th meeting.  

SS made a motion to adjourn at 6:40 pm.  KF seconded the motion and the Board voted 3-0 to adjourn.
