The meeting was called to order at 6:00 p.m.

Yokun Ridge Property Management, LLC:  A letter from the Board of Selectmen dated November 13, 2008 was reviewed.  The letter formally referred a petition from Dennis Welch on behald of Yokun Ridge Property Management, LLC, requesting a zoning change for his property located on Main and Cliffwood Streets.  In accordance with Chapter 40A, Section 5 of the General Laws, the Board needs to hold a public hearing and provide a report to Town Meeting on the proposed change.  It was agreed the hearing would be held on January 13, 2009 and that the matter should be considered by voters at the Annual Town Meeting in May.     

Berkshire Montessori School, Inc. Form A:  Presenting the Form A was Rob Hoogs of Foresight Land Services.  The property is located on the southerly side of Golden Hill Road and easterly of Patterson Road.  Mr. Hoogs stated that Todd Covert purchased a 28 acre parcel at Patterson Road and Golden Hill Road in September.  An agreement has been reached between Mr. Covert and three abutting property owners who want to buy some of the property to add to their existing parcels.  The parcels are not separate building lots.  They are to be conveyed to and become part of abutting properties.  

SS made a motion to approve the Form A as presented and GS seconded the motion.  The Board voted to approve 4-0.

Flexible Zoning Bylaw Examples:  Rob Hoogs of Foresight Land Services told the Board that he will be starting to work on this project in two weeks.  For demonstration purposes he will be using the Pine Knoll development, and sketch a development that would be allowed under the proposed new Flexible Zoning bylaw with different variations applied.  

Undeveloped Property:  MA told the Board that she had obtained a list of undeveloped properties in Lenox from Mark Maloy of Berkshire Regional Planning.  It is estimated there are 1,800 acres not yet developed.  She will provide this information to the Board members for their review.  

Inclusionary Zoning:  MA advised the Board that she had a general discussion with the Affordable Housing Committee with regard to an Inclusionary Zoning Bylaw.   The Board continued their ongoing discussion on how the proposed bylaw should be written.  MA will work on a re-draft to have for the Board to review at the second meeting in December.  The plan would then be presented to the public for their feedback prior to having a Public Hearing, with a target date of February, 2009 for a Special Town Meeting.  

Other business:  The December 23, 2008 meeting has been cancelled, but the Board tentatively scheduled a meeting on December 16, 2008 6:00 pm.

Minutes: KM-V made a motion to approve the minutes of October 28, 2008 with a minor edit and SS seconded the motion.  The Board voted to approve 3-0-1, with GS abstaining as he was not at that meeting.


Old Business:  JK reviewed the notices and decisions from abutting communities. There was also a letter from Tom and Suky Werman of Stonover Farm in which they asked the Board to consider Stonover Farm for inclusion in the Great Estates category.  

SS made a motion to adjourn at 7:00 pm and GS seconded the motion.  The Board voted to adjourn 4-0.
