Board of Health Minutes 10/01/2003
Town of Lenox
Board of Health

Minutes of Meeting - October 1, 2003

Members Present:        Andrew J. Breslin, Chair, Marie V. Feder, Joseph A. Kellogg

Chair A. Breslin called the meeting to order at 7:30 p.m. in the Lenox Town Hall.
Minutes of the September 3, 2003 meeting were reviewed and signed by all members.

Two different subdivision plans which had been left in the Board’s mailbox earlier in the day were reviewed.  One was the final definitive plan for the Stoney Ledge development, located on Housatonic Street.  A note from Rob Hoogs, with Foresight Land Services, was included with the plan asking that the Board sign the mylar for recording in the Registry of Deeds.  All members noted that this submission was the first received by the Board and to their knowledge, no presentation had been made by the proponent nor had a recommendation been received from Peter Kolodziej of Tri-Town Health.  It was agreed no signatures would be affixed to the plan until such time as either a presentation was made or Tri-Town Health advised they had reviewed the plan and found it acceptable.  J. Kellogg said he would check with the Town Clerk and Tri-Town Health to assure that proper procedure was being followed relative to the filing of subdivision plans.  The second plan filed was only preliminary and involved a two lot subdivision on New Lenox Road at the former Frusciente property.
It was further agreed that the proponent of this subdivision should be invited to a future meeting for a formal presentation.

The mail was read and included letters from insurance companies advising of damages at properties located at 301 Old Stockbridge Road and 25 St. Ann’s Avenue; a letter from the Massachusetts Department of Industrial Accidents, informing the Board that permits should only be issued to corporate entities which submitted proof of workers compensation insurance; a letter from the Housatonic River Restoration group announcing a meeting they would be holding in Lenox on October 9th; and a memorandum from Tri-Town Health, forwarding a letter of complaint from an anonymous writer complaining about Town Hall employees smoking at the handicap entrance to Town Hall.  Board members agreed with the comments made by the complainant and suggested that the topic could be brought up when the Board met with the Selectmen on October 22nd .

A brief discussion was held relative to the Town Accountant utilizing funds from the Board’s supplies account for an expense which apparently should have been paid by the Town’s benefits account.  J. Kellogg said he would check with Amy Lane to determine why this deduction was made without the Board’s authorization.
