Members present: Chair Neal Carpenter, (NC); David Lane, (DL); Joseph Strauch, (JS); Rose Fitzgerald Casey, (RFC); Dick Ferren, (DF)
Absent with notification: Vince Ammendola, (VA)

Notice of Intent, David Ward, Stone Path Development, Inc., 241Walker St., Map 8 Parcels 1 & 6-1.  The project is the construction of a 9 unit residential development with associated roadway and driveways. First hearing November 2, 2017. Continued to November 16th. Continued again to December 21st. On December 21, applicant requests to continue to January 4, 2018. Due to the inclement weather the meeting was continued to January 18, 2018. Applicant requested another continuance to Feb. 1, 2018.

NC read a request from Sarah Gapinski of SK Design asking the Commission to again continue, with the date requested February 15th. DF made a motion to continue to February 15, 2018. DL seconded the motion and the Commission voted to agree 5-0.

NC prepared and handed out to the Commissioners a document which had two Special Conditions suggested by Mike Kulig of Berkshire Engineering plus others that he was suggesting.  He asked the Commissioners to review and add conditions they thought would be appropriate and submit before the next meeting.

Discussion ensued regarding tree boxes that are being proposed and if the roots of the trees could possibly go into the pipe system.

They also discussed using a Gabion wire basket filled with six inch stones. The basket would be 10 feet long by 3 feet high and 2 feet wide. The basket would be placed at the end of the 18 inch outlet pipe and would sit on the stones of the level spreader. The Commissioners believe that this would be much better than the three boulders the Applicant has proposed.  

Notice of Intent, Edward Merritt, 139 Lime Kiln Rd., Map 27 Lot18.  The project proposed is construction of a 24’ X 30’ garage in the northwest corner of the property. The property is partially in the outer riparian of the riverfront.  On Feb. 1, 2018 applicant requested another continuance to Feb. 15, 2018.

NC read a request from Rob Akroyd of Greylock Design Associates to again continue the hearing to February 15, 2018. DF made a motion to continue the hearing to February 15th and JS seconded the motion. The Commission voted to agree by a vote of 5-0.

On January 31st, the Commission was advised by Natural Heritage that this proposed project does not require review pursuant to the rare wildlife species section of the Massachusetts Wetlands Protection Act Regulations or Massachusetts Endangered Species Act Regulations as the project does not occur within mapped Priority or Estimated Habitat.  

Mass DEP has not yet issued a file number for this Notice.  

Approve Minutes:
December 21, 2017-JS made a motion to approve the minutes and RFC seconded the motion. The Commission voted to approve 4-0-1. DF abstained as he was not at that meeting.
January 18, 2018- Both applicants for the hearings scheduled requested earlier to continue to February 1, 2018. NC opened and closed the public hearings as required by the Open Meeting Law. He was the only person present. The minutes were provided as a record and he approved.

Laurel Lake, Certificate of Compliance

RFC made a motion to adjourn. DF seconded the motion and the Commissioned voted in favor 5-0. The meeting was adjourned at 8:00 PM.
