Also present was Sean VanDeusen, Superintendent of the DPW.

NOI, Town of Lenox Department of Public Works, Root Water Treatment Plant, 471 Reservoir Road, Map 15 Parcel 2, construction of upgrades to the High Lift and Low Lift Pump Stations e.g., installation of a new emergency generator and associated conduits, installation of three new propane storage tanks and associated piping, and a new concrete entrance pad, portions of which are located within the 100-foot Buffer Zone to Bordering Vegetated Wetlands.  (On 8/19/2014, Sean VanDeusen asked to continue to Sept. 4, 2014, 7:30 pm.)

There was a site visit on August 15th attended by Sean VanDeusen and Rick Fuore of the DPW and Commissioners TF, VA, JS, RFC and NC.

Erika Casarano and Jessica Hunt of AECom presented the site plan and provided details of the proposed work.  The Commission suggested a containment structure as a precaution in the event of a fuel leak as well as consideration of an alarm system to alert in the event of a breach.  The applicants responded that they would look into specs and details and get back to the Commission.

TF made a motion to approve the project as proposed with modifications and with a conditions that the table be updated with the revision to the square footage of the impact area and that a suitable design for containment structure beneath the diesel pad be submitted for the approval of the Commission before the diesel is fueled up and goes into operation.  RFC seconded the motion and the Commission voted to agree 7-0.  

TF said that this motion would allow the work to commence and that revised plans could be submitted for approval.   

DL said that he felt that a roof over the containment should be placed to keep water and snow out.  This was included in the Special Conditions of the Order of Conditions.

Presenting the application was Sean VanDeusen.  The elevation of the project is just above 1400 feet, the height at which the Scenic Mountain Act comes into play.  It was determined that nothing appreciable is affected by this project.

RFC made a motion to issue a Negative II Determination and VA seconded the motion.  The Commission voted to agree 7-0.  

Other business:
Rest of the River- NC reminded the Commissioners of the forum to discuss the clean-up effort of the Housatonic River.  (E-mail was sent to all of the Landuse Boards on September 3rd with links on this topic.) It will be held on September 10th at the Berkshire Scenic Railway Station, 10 Willow Creek road at 6:30 pm.  Everyone who can attend is encouraged to go.
Eastover-NC advised that Steve Mack of Foresight Land Services is still working on the changes regarding the NOI which came before the Commission on August 21st.  This matter is on the agenda for September 18th at 7:30 pm.   TF will go to the site prior to that meeting to review.
Nick Desantis, Melville Court-Regarding a residential development of 1999 when the Commission issued an Order of Conditions which required a restriction on a portion of the development.~ Mark Stinson of MassDEP contacted the Commission on September 2nd to advise that he had been contacted by an attorney representing Mr. Disantis regarding the restriction and Mr. Stinson recommended to the attorney that Mr. Disantis ask to be placed on the Commission’s next agenda.   Discussion ensued and it was agreed that NC will advise Mr. Desantis to come to the Commission to address the issue.

Approve minutes-August 21, 2014-RFC made a motion to accept the minutes with edits.  JS seconded the motion and the Commission voted to approve 6-0-1.  DF abstained as he was not at the meeting.  

RFC made a motion to adjourn and DL seconded the motion.  The Commission voted to adjourn by a vote of 7-0 at 8:45 pm.
