Town of Lenox, Request for Determination of Applicability. The proposed project is to fully reclaim and pave Frothingham, Maple, Reynolds, Taconic, Ash, Hubbard (Main to 7/20), Galway and Dunmore.  

Making the presentation was Sean VanDeusen, DPW Superintendent, who said the RDA was amended to include lower Walker St. which sustained significant damage as the result of a torrential rain on June 25, 2014.  Relative to the work on Walker St., he said that he had notified the Army Corps of Engineers and MassDEP.

VA made a motion to issue a Negative III Determination with addendum for modification as described. RFC seconded and the Commission voted to agree 7-0.

On July 5, 2014, TF and NC went to the site.  The Davises had not been aware that they needed to request a C of C until recently.  NC said that they had complied fully with the Order of Conditions.

TF made a motion to issue a Certificate of Compliance and JS seconded the motion.  The Commission voted to agree 7-0.

Other business
Emergency Certificate Forms issued on June 27, 2014:
    South-east section of Lenox and Lenox Dale-NC advised that he issued an ECF for the following work to be allowed:
Woods Crossing Brook at East St.-Log removal inlet/Head wall repair outlet
Saw Mill Brook at Hubbard St.-Log removal inlet/Head wall repair outlet
Saw Mill Brook at East St.-Log removal inlet/Head wall repair outlet
Woods Crossing Brook at Crystal St.-Log removal inlet/Head wall repair outlet
    353 Housatonic St.-NC advised that he issued an ECF for the following work to be allowed:
Repairs to upper headwall and driveway and remove logs and branches from inlet

Enviromental Notification-Eastover, 430 East St., Map 18 Parcel 85-NC advised that Steve Mack of Foresight Land Services will be filing an NOI for this project for a septic system.
Lenox Woods, David Ward’s property, Map17 Parcel 40, 55 Pittsfield Rd.  NC advised that on July 15, 2014 he went to the site as new foundations are now being put in for the approved new condominiums.  The site has been properly prepared to protect the wetlands.

Dennis Ross, 83 Sherwood Drive, Map 18 Parcel 7-NC checked the silt fence for this approved project for a new septic system.

Land Management Committee-NC reminded the Commission of this meeting for July 24th at 5:00 pm in the Land Use Meeting Room.  He and TF will be present.
