Request for Determination of Applicability, MassDOT for Route 7 & 20 (MM 25.51 to Lenox town line).  The proposed project includes cold planing and resurfacing of the existing asphalt pavement on the roadway and adjacent side roads and driveways, repairs to drainage structures, replacement of markings and traffic detectors, and installation of slotted pavement markers.  

Presenting the application was Nick Hopkins of MassDOT.  He provided plans and described the extent of the work.  There will not be any increase in impervious surface with this project.  DL wanted to be sure that the catch basins will be protected while working.  TF asked that particular attention is given to erosion control to protect the drainages, and that the Commission be notified before the work commences.    

DF made a motion to issue a Negative 3 Determination and DL seconded the motion.  The Commission voted to agree 5-0.  

Request for Determination of Applicability, Town of Lenox, Brunell Ave., Map 42 Parcel 27. The proposal is improvements to the existing Brunell Avenue Pumping Station.  Continued from June 5, 2014.

There was a site visit on June 6, 2014 and attended by Ingrid Jacobs, Ed Shull, and Mark Lenagagn: Superintendent Sean VanDeusen, Jeff White and Scott Winslow of the DPW; and Commissioners TF, DL and NC.  Also present was Town Manager Chris Ketchen.

The plans submitted at the June 5th meeting have been modified and were presented by Ingrid Jacobs of Weston & Sampson.  The locations of the basins have changed and the sizes have doubled.  The plans are to drill deep wells approximately 28 feet deep to dewater the area before digging commences.  Ms. Jacobs described how the system would work and stated that multiple measures will be taken to handle the water and to protect the wetland from overland flow for sediment and erosion.  Hay bales and silt fencing will be used.    In doing test holes for locating utilities and determining the location of what is on site, it was discovered that there is very little water.  

Mr. VanDeusen said that the trees the Commission permitted to be removed have been taken down and soon will be removed.  The Commission asked that they be notified when the work commences and as the project progresses.

DL made a motion to issue a Negative III Determination.   TF seconded the motion and the Commission voted to agree 6-0.

Other business:
     Lenox Beach-Site Visit, June 6, 2014.  NC and DPW Superintendent Sean VanDeusen went to look at dead trees.  NC gave approval to remove.  
     Lenox Inn, 525 Pittsfield Rd., Map 33 Parcel 6, There was meeting today, June 19, to discuss a proposal for a possible site of a Cumberland Farms.  Bill Thornton, Building Commissioner, called the meeting which was attended by representatives of various boards.  NC represented the Conservation Commission.  A representative from Bohler Engineering, who works with Cumberland Farms, is in preliminary stages to gather information.  
     Robert Spielman, 56 East Dugway Rd., Map 17 Parcel 52/53-Rob Akroyd of Greylock Design Associates has sent preliminary plans to DEP for a driveway. This matter is being overseen by David Foulis of MassDEP.
    Special Town Meeting-NC reminded all of a Special Town Meeting on June 24th in the Town Hall Auditorium in which there are three warrant articles. Article 2 is to see if the Town will authorize the Board of Selectmen to accept from Sawmill Realty, Inc., as a gift, two (2) parcels of land, a combined total of almost five acres,  as conservation restricted land.  Note: At the April 3, 2014 meeting the Commissioners voted unanimously to recommend the Town consider accepting the gift subject to the Conservation Restriction.   This property is at the end of Stoneledge Road.    

Approve minutes-June 5, 2014-TF made a motion to approve the minutes with one edit.  DL seconded the motion and the Commission voted to approve 6-0.

TF made a motion to adjourn and JS seconded the motion.  The Commission voted to agree and the meeting was adjourned at 8:15 pm.
