Request for Determination of Applicability, Berkshire-Cranwell LIM/Partner c/o Peter Burack for property located at 55 Lee Rd., Map 3 Parcel 54-The proposal is to remove the Stump Dump and disposal, and restoration for the protection of adjacent resource areas.  

Making the application was Marc LeVasseur of Foresight Land Services.  Mr. LeVasseur reviewed the site plan and detailed the project.  

Mr. LeVasseur stated that this is a registered hazardous dump and the purpose of the project is to do away with that status.

TF made a motion to issue a Negative 3 Determination and VA seconded the motion.  The Commission voted to agree 6-0.  A condition to the approval is that the Conservation Commission be called when the siltation devices are in place and before any work commences.  
There was a site visit on February 27th that was attended by Mr. LeVasseur, TF, NC and VA.

Request for Determination of Applicability, Dennis Ross, 83 Sherwood Dr., Map 18 Parcel 7. The proposal is to upgrade the failed septic system to bring into compliance with Massachusetts State Environmental Code Title 5 310 CMR 15.

Presenting the application was Ken Boudreau for Hill Engineering.  He reviewed the site plan and described the Perc Rite Drip Dispersal System which reduces the size of the footprint.  There will be a temporary gravel drive installed and some tree removal.

JS made a motion to issue a Negative 3 Determination and VA seconded the motion.  The Commission voted to agree 6-0.   A condition to the approval is that the Conservation Commission be called when the siltation devices are in place and before any work commences.

The site visit for this project was on February 27, 2014 and attended by Ken Boudreau, NC, VA and TF.

Other business:
Newberger-Map 27 Parcel 34, 132 Lime Kiln Rd., Josh Allentuck contacted NC to advise him that as per the discussion at the February 6, 2014 meeting,  the trees had been marked for removal and pruning for the Conservation Commission to view.  DL and NC went to the site and advised the Commission that the trees marked to be taken down were on the open edge of the driveway and all were dead.  The trees marked to be trimmed were leaning over the house.  The Commissioners agreed that the work proposed was considered to be maintenance.  
 
Eastover-Map 18 Parcel 85, 430 East St. Eastover- On February 12, 2014, Jeffrey Reel, an employee at Eastover, notified the Commission via email that Yingxing Wang, the owner of Eastover, would like to meet with the Commission to discuss that part of the property that once served as the buffalo pen and included a pond. There were several questions regarding the ability to do plantings, excavation, installation of drain pipes and channeling water, etc.  NC told the Commission that he advised Mr. Reel that such work would require the filing of a Notice of Intent and suggested that they hire an engineering firm.  

Approve minutes-February 20, 2014.   JS made a motion to approve the minutes and TF seconded the motion.  The Commission voted to approve 6-0.
