Request for Determination of Applicability, Peggy VanZandt (Crystal Street Nominee Trust), 140 Crystal St, Map 4 Parcel 65.  The proposed project is the installation of a new water main that will connect into the existing private water main located along the north side of Valley Street.  The proposed work falls within the buffer zone of top of bank, the riverfront area and the floodplain of the Housatonic River.  The project requires a trench to be dug for the placement of the pipe.  Following the installation, the area will be restored to original condition.  

Jaimy Messana and Peggy VanZandt presented the application.

On Tuesday, September 10, 2013, there was a site visit.  In attendance were:  Jaimy Messana, Peggy VanZandt, NC, VA, JS, RFC, and DF. TF and DL went at another time.

DF made a motion to issue a Negative Determination 2.  JS seconded the motion and the Commission voted to approve 6-0.

Other business:
        JR Flynn, 144 West Mountain Rd., Map 32 Parcel 2-On September 10th, following up on the September 5th meeting, a site visit was conducted.  Present were:  NC, VA, JS, DF, TF and Mr. Flynn.  NC restated that Mr. Flynn had approval to use this property in connection with his tree surgeon business.  It was noted that there were a few discrepancies that were not of a major nature.  Mr. Flynn will remedy and NC will follow up to assure compliance.  

        57 Bramble Lane, Map 1 Parcel 43-On September 12, 2013, NC met with a Realtor® from Wheeler and Taylor who has a potential purchaser who may be interested in this property, but are concerned about five or six trees that are leaning over the house and wanted to know if the Commission would take issue if the trees were removed.  NC said he advised the Realtor® that an RDA should be filed.  

        Terry Burman, 40 Brunell, Map 42 Parcel 30-On September 13, 2013, NC met with Mike Kulig of Berkshire Engineering, to determine if the Commission could issue a Certificate of Compliance.  NC noted there were some discrepancies with drainage and advised Mr. Kulig that this needed to be corrected prior to issuance of a C of C.  It is believed that the design for the detention basin as presented was not executed correctly and should be remedied.  
  
Approve Minutes: September 5, 2013-JS made a motion to approve the minutes as amended and DF seconded the motion.  The Commission voted to approve 6-0.  

DL made a motion to adjourn and VA seconded the motion.  VA seconded the motion.  The Commission voted to agree 6-0 and the meeting was adjourned at 8:20 pm.
