Town of Lenox, Jeff Vincent, informal discussion to evaluate the possibility of a viable town water source on town owned land in the town watershed.

Mr. Vincent told the Commission that there is a cistern on town owned land in the town watershed that had been a water supply for the historic Aspinwall Hotel which was destroyed by fire many years ago.  He feels that it would be worthwhile for the town to investigate this cistern to see if it could be a resource for increasing the town’s water supply.  Mr. Vincent sought the Commission’s advice on the procedure to be followed to permit the testing to determine if this is a viable resource.

The Commission advised Mr. Vincent that he should file an RDA for the preliminary testing.  The results of the tests will determine what further procedures would be required.  .

It was agreed that there will be a site visit on Tuesday, June 25, 2013 at 9:00 am.  

Notice of Intent, Robert Speilman. 56 East Dugway Dr., Map 17 Parcel 52/53.  Proposed project is the alteration of an on-site wetland to provide more open water in the form of a 0.9 acre pond with replicated wetlands surrounding that is equal to wetlands displaced.  Note: On June 19, 2013, Rob Akroyd called to request this hearing be continued to July 18, 2013.  

DL made a motion to continue the hearing to July 18, 2013 at 7:30 pm.  JS seconded the motion and the Commission voted to agree 6-0.

Request for Determination of Applicability, George Darey, 100 Hubbard St., Map 47 Parcel 56.  The proposal is to build a 24’ X 24’ garage within the 100 foot buffer zone.   

A site visit was held on June 12, 2013 and attended by TF, JS, VA, and NC.  DL has already been to the site.  

TF made a motion to issue a Negative III Determination.  VA seconded the motion and the Commission voted to agree 6-0.

Other business:

Haddad, 178 New Lenox Rd.-Map 28 Parcel 130. There will be a site visit on Wednesday, June 26, 2013 at 9:00 am to be attended by NC, DL and TF to inspect the removal of the dirt that was done this week as required by the Commission.  NC will contact Mr. Haddad and his son-n-law, George Bliss to arrange for a discussion on what additional steps are necessary to remediate the area and to reduce the width of the access to the property from East St. After this discussion, the Commission will issue a letter to Mr. Haddad outlining the Commission’s requirements.  
Electric Power Research Institute, 115 East New Lenox Rd., Map 34 Parcel 1. NC went to the site on June 10, 2013 and met with Joe Potvin.  The project is proceeding as permitted.  

Carlos Zaffenalla, 6 Melville Ct., Map 8 Parcel 76-8. NC went to the site on June 18, 2013 and found the silt fencing and hay bales is in place.  

Yokun Ave., formerly the Krofta property.  The Commission continued discussion from May 16, 2013 regarding a wash out on property now owned by Ethan Berg.  DL has spoken with the owner to make him aware of the Commission’s concerns of silt flowing down from a ravine into Parson’s Marsh.  The owner will be out of town for much of the summer, but DL will advise him to consult with an engineer and redesign a new basin and determine how to remediate the damage to the wetland.  Note: NC found an old file in the basement which granted permission to the former owner, Milos Krofta to create the basin. It is believed that the rear wall of the basin was damaged during an exceptional storm a few years ago.

Approve Minutes-June 6, 2013-DF made a motion to approve the minutes with one minor edit.   JS seconded the motion and the Commission voted to approve 6-0.  

VA made a motion to adjourn the meeting at 8:11 pm and DF seconded the motion.  The Commission voted to agree 6-0.
