Request for Determination of Applicability, Lenox Green Partners Dacey, 41 Pittsfield-Lenox Rd., Map 17 Parcel 39.  Request to determine if the work to demolish the existing structure is subject to the Wetland Protection Act.

On March 28th there was a site visit that was attended by NC, VA, JS, TF and Shannon Boomsma of White Engineering, Inc.

Ms. Boomsma presented the application.  A silt fence will be put up at tree line.

TF made a motion to issue a Negative Determination 3 with the following stipulations: The Commission is giving approval for the work requested only, approval is not being given for any actual wetland boundaries, and any future work would require notification.   

RFC seconded the motion and the Commission voted to approve 6-0.

Request for Determination of Applicability, Berkshire Natural Resources Council, located near Old Baldhead Rd., Map 10 Parcel 2.  Request to determine if the work to install a dimensional lumber bridge over an intermittent stream is subject to the Wetland Protection Act.

There was a site visit on March 28th attended by TF, NC and Amanda L’Etoile.  

TF asked Ms. L’Etoile to give the Commission a map with the bridge location and an updated sketch of the proposed project.  Both documents were included in the RDA application but were washed out from photo copying.  She will email tomorrow.  (These documents were received on April 5th.)

The bridge is proposed to be 36” wide.  

VA made a motion to issue a Negative 3 Determination with the provision that a new drawing be submitted that will show the proposed bridge extending 16 feet or longer.  JS seconded the motion.  The Commission voted to agree 6-0.

Amend Order of Conditions that was filed 11/18/2011, David Friedman, 174 Main St., Map 46 Parcel 29.  Applicant wishes to expand the multi-court.  MA DEP File # 198-0267.  

A request and new plan (plan dated 03/27/2013) were submitted by Rob Akroyd on March 28, 2013.  

Mr. Akroyd was not present, but the Commission reviewed the request and plans and determined that an Amended NOI would be required as well as a better set of plans for elevation etc.  (PA relayed this information in an email to Mr. Akroyd on 04/05/2013.)

Approve Minutes: RFC made a motion to approve the minutes of February 21, 2013 and JS seconded the motion.  The Commission voted to approve 6-0.

Other Business: NC advised the Commission that on March 26, 2013 he and TF met with Broadway Electrical Co., Inc. at the treatment plant and landfill to discuss wetland issues regarding possible solar installation.  There is a significant wetland across the north end of the landfill.  It is anticipated that plans will be filed at a later date and a site visit conducted.  Attending the site visit were the following: Operations Manager John Gallagher and Project Manager Dennis C. Daru Jr., both of Broadway Electrical Company, Inc.; Richard Kirby of LEC Environmental Consultants; and Sean VanDeusen, Superintendent of the DPW.   

RFC made a motion to adjourn and DF seconded the motion.  The Commission voted to agree and the meeting was adjourned at 8:25 pm.  

DL arrived after the meeting was adjourned.
