Edward Merritt, Lime Kiln Rd., Map 27 and portion of Parcel 18- Rob Akroyd of Greylock Design Associates, anticipating that all details will be in place and agreed upon so that both Enforcement Orders can be lifted. This is relative to the Enforcement Orders issued on August 3, 2012 for MA DEP file numbers 198-0234 and 198-0219. This meeting has been continued from December 20, 2012 and January 17, 2013. At the December 20th meeting, Mr. Akroyd made changes to the plan and documented that date. He then agreed to the Commission’s request to submit a letter noting those changes. On January 17th, prior to the meeting, PA contacted Mr. Akroyd via email to advise that as of that date, the Commission had not received the letter. He
said he would not be at the meeting, but he would be submitting the letter. Mr. Akroyd’s response was shared with the Commissioners and the consensus was that until the Commission had this information they would not move forward on this matter. The meeting was continued to February 7, 2013.
It was noted at tonight’s meeting the letter still has not been received.
RFC made a motion to continue the meeting to February 21, 2013 at 7:30 pm. DF seconded the motion and the Commission voted to agree 7-0.
Laurel Lake Preservation Association, Order of Conditions File number (198-0242). Discuss request emailed by Mark Alimansky on January 18, 2013 to amend the Order of Conditions as well as the latest the final report/evaluation of the effects of the Laurel Lake water drawdown for the winter of 2011/2012 and the subsequent year.~ It was authored by Dr. Ken Wagner, Water Resource Services, under contract to the Laurel Lake Preservation Association, Inc.
The text of Mr. Alimansky’s email is as follows:
This is to notify the Lenox and Lee Conservation Commissions that, pursuant to the Permit Extension Act, Section 173 of Chapter 240 of the Acts of 2010 and extended by Sections 74 and 75 of Chapter 238 of the Acts of 2012), the LLPA requests amending the original Orders of Conditions for drawdowns of Laurel Lake for the permitted number of years.
The Permit Extension Act was established for an automatic four-year extension to certain permits. All of conditions of the original Order of Conditions still apply.
DF made the motion to grant the request and JS seconded the motion. The Commission voted to agree by a vote of 7-0.
Other Business:
- Lenox Commons, aka Lenox Woods South, formerly Aspinwell, 55 Pittsfield Rd., Map 17 Parcel 40. Today the Commission received a copy of a letter to Karen Hirschberg of DEP from SK Design Group relative to the Request to Amend Superseding Order. Ms. Hirschberg had requested additional information and SK Design’s letter was their response to that request.
- Open Space and Recreation Plan: DL, JS, NC, TF attended the public forum held at the Town Hall on January 30, 2013. The results of that meeting were discussed and the Commissioners shared the opinion that presently the Town recreation areas have good separation which should be maintained as multiple uses on one property results in conflicts among users. Students from the Conway School of Design will be putting together a report of the forum as well as a survey which will be distributed to the public for their in-put.
- Community Preservation Committee-JS said that the CPC would be meeting February 11 to hear applicants present their projects.
Approve Minutes-January 17, 2013- DF made a motion to approve the minutes as amended. TF seconded the motion and the Commission voted to approve 6-0-1. NC abstained as he was not at the meeting.
